Rockland County, NY – A Peekskill police officer has been cited for four traffic violations in a September collision on darkened Ramapo roadway that took the life of a 17 year yeshiva student.

As previously reported on VIN News (http://bit.ly/2cRLSnv), Marcos Tawil of Argentine was standing in the driveway of Yeshiva Tiferet Torah on Route 202 just before midnight on September 8th when he was struck by a car driven by Officer Jonathan Mosquera.
Police said that Mosquera attempted to illegally pass a Honda making a left turn into the yeshiva’s driveway when the two cars collided, with Mosquera’s car striking both Tawil and fellow student Daniel Maldonado who were standing in the driveway. Tawil was pronounced dead at Good Samaritan Hospital in Suffern, while Maldonado was taken to Westchester Medical Center in serious condition.
Early reports by The Journal News stating the yeshiva was operating illegally at the Route 202 were incorrect and were removed with no admission of error by the newspaper.
According to police, neither drugs nor alcohol were involved in the fatal crash. Police said that Mosquera was speeding at the time of the accident and the three month long investigation also revealed that Mosquera improperly passed the Honda which was driven by 19 year old Tzvi Hakakian.
Mosquera was issued four summonses for speed in zone, speed not reasonable and prudent, moving from a lane unsafely and improper passing. Hakakian was ticketed for moving from a lane unsafely and making an improper left turn on a two way roadway.
It is unclear why Hakakian was ticketed for an improper left turn. According to the New York State Department of Motor Vehicles drivers are allowed to cross a solid double yellow line to enter a driveway.
It is also unknown whether Mosquera will be disciplined for his actions.
The police chiefs and public information officers at both the Ramapo and Peekskill police departments were all unavailable for comment today.
That reckless cop should have been charged with vehicular homicide. If it was a civilian, they would have been charged, with that crime. However, cops routinely violate the law with impunity.
Why don’t they arrest this faarsholtana cop and charge him with manslaughter.

If the situation was other way around and the yeshiva bochur was speeding, speed in zone, speed not reasonable and prudent, moving from a lane unsafely and improper passing…. I have a feeling the bochur would be in jail. The cop probably deserves criminal charges not tickets.
