The lawsuit, by resident Daniel Rosenblum, charges the municipality should have known that it and other villages would be found by a court to lack standing to sue the town over environmental matters beyond their boundaries.
Wesley Hills, Chestnut Ridge, Montebello and Pomona are appealing the June 13 decision of the state Supreme Court that dismissed their arguments against the master plan and its zoning for adult student apartments tied to religious yshivah school.

Rosenblum’s lawsuit, filed in state Supreme Court in New City, seeks repayment of legal fees totaling $78,394. It also wants Wasley Hills trustee Rosenstein, Mayor Robert Frankl and Trustee David Goldsmith penalized $10,000 each, and either suspended or removed from office.
“Defendants knew or should have known that the Village’s proceedings and action would likely be dismissed, as a matter of law,” charged the lawsuit.

But assistant village attorney for Wesley Hills, called that “nonsense, complete nonsense,” and ludicrous.
