Police said that no official charges have been filed at this time and that they could not say if an arrest was imminent in the incident which took place shortly after 3 AM on Tuesday morning at a 39th Street home in Borough Park.

According to ABC News (https://7ny.tv/2HIQvAS), the suspect has ties to the area and is being interviewed by detectives from the NYPD’s Special Victims Unit.

Police have been investigating the incident as a possible sex crime and told VIN News that the intruder put his pants on as he fled the scene. But friends and family have argued that narrative, saying that the man was a burglar who lost his footing when he tried to enter the home through a window located above her bed.

Chaya Tomlin, described by ABC News as the family nanny, said that both the girl and her 14 year old sister with whom she shares a room, saw the man coming into their room.

“They screamed really loud, so he flew and left his bike and sweatshirt,” said Tomlin. “They screamed so loud that he didn’t have a chance for anything, he just ran.”

As previously reported on VIN News (http://bit.ly/2HHTUQk), sources said that girl was not physically harmed by the intruder.

They are trying to protect the girl. Don’t advertise that its a potential rape. We need to protect the victim.

the NYPD is going to make this into just an attempted burglary its all about showing that crime is “falling”, clearly this is an attempted rape of a minor by an illegal Latino, but if they call it a rape then he can deported, however a misdeamonor wont lead to that as de bozo has a sanctuary city.

I think its pressure from the community askunim not to call it attempted rape. Doubt it’s got anything to do with police statistics.

Sounds like he may be one of the many delivery persons that Boro Park residents rely.
