New York - NY Sues To Dissolve Trump Foundation, Cites Illegal Conduct

New York - New York’s attorney general on Thursday sued U.S. President Donald Trump and his namesake foundation, saying the nonprofit should be dissolved after more than a decade of illegal conduct, including support for Trump’s 2016 U.S. presidential campaign.

Barbara Underwood, the attorney general, accused the Donald J. Trump Foundation and its directors of conducting “extensive unlawful political coordination” with the campaign, and “repeated and willful self-dealing” to benefit Trump’s personal and business interests.

Advertisement:

“The Trump Foundation was little more than a checkbook for payments from Mr. Trump or his businesses to non-profits, regardless of their purpose of legality,” Underwood said in a statement. “That is not how private foundations should function.”

The foundation could not immediately be reached for comment.

Trump’s children were also named as defendants in the attorney general’s petition, filed with the New York State Supreme Court in Manhattan.

New York is also seeking $2.8 million of restitution plus penalties, a 10-year ban on Trump serving as a director of a New York nonprofit, and one-year bans for his children Donald Jr, Eric and Ivanka.

Having dealt with private foundations for 42 years now, I can say that much of what was reported by the media constituted blatantly illegal actions by the Trump Foundation. I have heard nothing similar with regard to either the Clinton or the Carter foundations (even if some sources of support of either questionable).

Here is a clear litmus test if its "merit based" . Say Trump was not president would NY still go after him? Do you have nay doubt that the point is to deligtimize Trump??

Or maybe because the attorney general of Florida already investigated this in regards to the interaction with his properties there, and found nothing illegal.
This is not about always pro or con, but about looking at the facts and reaching an intelligent conclusion. If there was illegal activity for over a decade, then why now? The fact that they were investigated was bias, regardless of wether the actual charges may not be.

So then lets see the following 2011 memo that was uncovered in 2016:

“Independent of our fundraising and decision-making activities on behalf of the Foundation, we have dedicated ourselves to helping the President secure and engage in for-profit activities — including speeches, books, and advisory service engagements ... In that context, we have in effect served as agents, lawyers, managers and implementers to secure speaking, business and advisory service deals. In support of the President’s for-profit activity, we also have solicited and obtained, as appropriate, in-kind services for the President and his family — for personal travel, hospitality, vacation and the like.”

The foundation wants to shut down. The New York AG didn't let them till now.
It previously admitted to violating a federal rule on a nonprofit's use of funds.

In a 2015 tax filing, the foundation acknowledged that it had violated the self-dealing law; however, for 2016's filing, it reported that it hadn't. The foundation was under investigation during the 2016 US presidential election after it was discovered that it may have misused its funds, including allegedly using it to settle lawsuits.

If he wasn't President, no, no one would have bothered. When you enter politics, you open yourself to scrutiny. He claimed to donate to Tampa police but actually charged them to use Mar-a-Lago for fundraisers. The more attention a person calls to himself, the more attention he receives.

Hail Victory translated into German is Sieg Heil. And the populist frenzy in late Weimar was painfully similar to such frenzy in many other places, including in 2018 United States.

Like in Germany, it’s become a cult of personality, Trump and his ignorant, populist hoards, seething with their aroused sense of victimhood and their scapegoats. We’ve seen this in many places over the past 100 years. Today its all amplified by social media and the Internet age. It's dangerous.
