Jerusalem – Father and His Kallah Daughter Arrested for Praying on Har HaBayit

    Har HabayitJerusalem – Police detained an Israeli man and his daughter for a few hours after they ascended the Temple Mount and began to pray at the contested holy site, the Jerusalem police spokesperson reported.

    David Kirschenbaum told The Jerusalem Post he went up to the mount with his daughter on the day before her wedding, in order to take in the holiest site in Judaism.

    Kirschenbaum denied he prayed at the site, but said that he was pointing at sites on the horizon and police mistook his daughter’s nodding for Jewish prayer.

    Kirschenbaum said he was then led away from the Mount by police and taken for an investigation at a Jerusalem police station. He said police told them he was being provocative and when he disputed the arrest, they told him they “don’t want to get into a discussion over politics.”

    Kirschenbaum, who has no criminal record, was not charged with any crime and said he was not handcuffed during his arrest, though he was fingerprinted and made to sign an affidavit vowing he would not disturb the peace again.

    This place is a powderkeg and needs only the slightest spark to ignite rioting. the police acted properly in arresting these troublemakers. They should know that either davening or even any innocent actions that might be confused with davening are totally assur from all the signs posted everywhere going up to har habayis. This is no different than the “innocent jokes” at airport security stations. If you stick your neck out, it will be cut off. If you cannot control your hand and body actions, stay OFF har habayis.

    First of all this guy has no business going on the har habayis it is against HALACHA according to most poskim of this generation and previous. Don’t even mention tendler he’s irrelevant. My other point is that its a real shame that you can get arrested for praying in israel and that praying is provocative. The har habayis is ours it always was ours and the only reason the arabs want it is because it is ours. We want moshiach to come now!

    Did they let the kallah out of jail in time for the chassanah? That would have been a shame but they shouldn’t have been at makom hakodesh and the rabbonim have said it is prohibited for yidden to step foot on what may have been the kodesh hakdoshim (unless of course the chassan was Rav Tendler’s grandson, in which case they probably hold by his postion).

    His daughter the kallah could easily have been hit by palestinians throwing stones or worse she could have been stabbed or shot. What kind of father brings his daughter to a very dangerous place the day before her wedding? Idiot!

    As one more famous than Rav tendler said, i may not know exactly where the beit hamikdash stood, but i know for sure where on the har habayit it did not stand. i assume rav tendler is correct in stating it is certainly permitted to go where you are sure the har habayit was not. others either have less knowledge (the har habayis is MUCH, MUCH larger than the area described in masechet midot for the beit makikdash) or have decided to asser the whole area for other reasons, perhaps legitimate.

    i may be worng so dont go screaming.

    but…

    there is a place were one can go up part of one of the path leading to a gateway entrance (Shaar) and not be on the makom hamikdash yet see almost everything. – maybe the partoopers gate? dont remember – i was kid about 25 years ago.

    you must go with someone who knows exactly how far on can go on the pathway upto the gate. its not the one on the side of the kosel.

    There can be no greater chillul hashem than this.
    That a Jew can not be allowed to daven in the focal point of all tefillos.
    Har Kodshi Bais Tefilla.
    Yet these tumadikke nochrim and areilim tourists freely walk around there.
    I am not talking about Halachah now.
    This is a statement of a very sad state of affairs.
    The golus hashchinah is simply so great that your heart is torn and you can cry.

    You guys are missing the point. This is Har Habyis, the epicenter of Judaism! This is an area on Israeli control, and still you can get arrested for going there.
    And some ignorant yeshiva people want to split Jerusalem. How much worse will it get? We won’t even be able to go to the Kosel!

    Halacha aside, the fact that we cow-toe around the arabs in our country is ridiculous. Usraeli law should not dictate this.
