Brooklyn, NY – She survived the Holocaust. But  a tenacious life story wasn’t enough for 92-year old Eta Eckstein to keep her Brooklyn landlord at bay.

While out of her apartment in a rehab facility, the grandmother got evicted.

“It’s unspeakable,” says Eta’s grandson, Idan. “They just threw her belongings onto the street.” Eta’s family got no explanation from the landlord, Morris Piller.

They believe he wants her out of the $600-a-month rent-controlled apartment on Bay Parkway in Bay Ridge, where she’s lived for 40 years.

An attorney for landlord Morris Piller disputes the family’s account. He maintains Eta Eckstein hadn’t lived in her apartment for quite some time, which is a legal no-no in New York City. “This was a legal eviction,” said lawyer Robert Rosenblatt. “The tenant had not occupied the apartment for two years.”

The issue is not the holocaust survivor she lives comfortably in the old age home. The problem is the kids could take over the apartment and hold on to the rent control status and only pay $600 unfairly to the landlord.
I think the landlord did the right thing if he could still do it.

The landlord could not evict her if she had paid her rent. Obviously she failed to pay rent even after numerous court notices and chances. Then the judge issued a warrant of eviction and she ignored that too. So what do all you idiots expect the landlord to do? Just let her live in the old age home, not pay rent on the apartment and let it sit vacant and lose thousands of dollars?????

Interesting.. Everybody knows all the facts here, some bloggers would jump up with angry silly comments on the landlord’s account without knowing any facts.
Did you all check when was the last time she paid rent? Did you check if she lives at this home at all? Did you check how long she has been living in a nursing home not even seeing her apt.?
Just fill up all your big mouths with water before you open it to mock a good hearted nice fellow.

what about the judge who signed the papers allowing the eviction?
this appears ti have been done legally
the nyc legal system is notoriously pro tenant
with that said i am sure there is alot more here than meets the eye
perhaps a reasonable compromise fair to both sides can be worked out.

I don’t know if you noticed but to me it seams like everyone agrees she’s not living in the apartment she’s in a rehab an eviction doesn’t happen in one day so the grandchild must of had plenty of time to take out all his belongings.

When this landlord goes for din vecheshbon I hope all his family that were killed in the holocaust give him the “welcome” he deserves. For Shame. All in the name of a buck. He should check his yeechis

I do not know the details of either party, but, I am a landlord, and I think I get the raw end of the deal. The tenants think I am responsible for everything that needs fixing even if they break it, and my hands are tied in raising the rent even though my taxes and expenses go up every year. If the elderly woman wasn’t occupying her apt. for 2 years, it is highly unlikely that she’d ever go back there, and I am sure the landlord didn’t suddenly throw her things out, but let the family know numerous times of his intentions before he did so. So before either party gets bashed, you have to know all the facts, before you take sides.

Pls stop just blogging when U don’t know any facts ! I know the LL the manager the attorney and the judge -i don’t know the tenant b/c she hasn’t lived there in years ! every move was done by the book as always and according to the law

If this is as the grandson claims, I hope they go to court. Let a judge review this and provide justice. But if the grandson is right, and this is an illegal eviction, then SHAME on Morris Piller.

The housing court judges are notoriously pro tenant. SO if he got an eviction order, she is not living there, period. Maybe the kids wanted the apt to inherit for $600 and now they make a stink. And why should the laws allow a grandchild to inherit the same rent controlled rent?? Its the CIty who is the Gonev and landlords have to protect themselves.

What if she paid the rent? What if this is really her home? What if this is really about a landlord using dirty tricks to kick a 92 year old woman out of a rent controlled apartment onto the street to increase the rent? Does it matter that she survived the Shoah? Who then is the Gonev, and what has Mr. Piller stolen?

If you watch the clip on nbc, you would see ther were numorous amount of letters sent to the tenant, witch should of given them pleanty of time to get her stuff out,and the fact is she dosent live there so i dont get the point of this story at all! except “Bored Media”

Check NYC records. This apartment is not rent controlled it was rent stabilized . Big difference!

How about the THOUSANDS of you who wrote and called and became a nuicense in trying to prevent killing a cold hearted murderer all get together and help this woman?? You can call and harrass people until the cows come home for a fellow Jew, how about you unclench your wallets and help your sister?? No one lives for free…..so, lets see all the help poor in for her.

Since when does she have a right to use someone else’s space as her storage area? If we take everything in the article as true, we see she was paying below market rent and was not in residence in the apartment. If she is going to seek the benefit of the rent control laws, she must also comply with the burden, that is reside in the unit at least 181 days a year. Why should the LL be required to pay her forced charity with below market rent just to allow her to use an apartment he could rent at market rate as a storage facility?

In order to throw everything out in the street, the sheriff had to be armed with a court order of eviction. In NYC it takes MONTHS to get one of those and in Brooklyn likely longer. In all that time none of her “loving” children or grandchildren checked her mail to see the legal notices? No neighbor warned the family?

The rent laws ruined this city.

I heard that the family has gone to court. Brooklyn Judge is hearing the case at 9:30 am Monday. Behatzleha.
