Albany, NY – Assemblyman Dov Hikind (D-Brooklyn) announced today that as a result of successful lobbying efforts, Assemblyman Richard Brodsky will not seek passage of his presumed consent legislation (A09881; A09865). Had the bill passed, New York would have become the first state to presume people wish to donate their organs unless they specifically opt-out. Hikind, along with leaders of Agudath Israel and other community activists, met with Assemblyman Brodsky yesterday to outline their concerns and objections.

“There was no doubt in my mind that if this bill had become law, we would have ended up fighting protracted legal battles to prevent illegal organ harvesting,” said Hikind. ”I felt this legislation was tantamount to entrapment.”
Hikind noted that Assemblyman Brodsky was extremely sensitive to the religious and ethical concerns presented to him by the delegation. Mr. Brodsky’s eventual determination not to pursue the presumed consent bill was a result of this meaningful dialogue.
Earlier this month, Hikind had launched an opposition campaign to prevent the bill from moving forward in Albany. He had been joined by the Rabbinical Alliance of America, The Catholic League, The National Council of Young Israel and leaders from Chesed Shel Emes.
