Mea Shearim – Outrage at Plea Deal for Mother Accused of Starving Son

    Dr. Michael Weintraub described the terrible state to which the child had deteriorated, and it seems this may have prompted the renewed efforts to agree to a plea bargain she had previously rejected on advice from her rabbis.

    According to the agreement, the mother will be under house arrest for three years, and kept away from the children for five years except under conditions to be determined for visiting. She is also expected to undergo medical treatment. After two years, if she meets the conditions of the plea bargain, she will be able to see her children in their house under observation for a few hours each day.

    The senior doctor from Hadassah Mount Scopus Hospital in Jerusalem gave testimony for about an hour regarding the signs he had discovered in the boy H., who was three years old at the time, and the behavior of his mother, which he described as “violent acts.”

    When he was first brought to hospital, the child had undergone extensive checks to ascertain what was causing him so much suffering, when in fact doctors were seeking a disease that didn’t exist.

    Each time medical teams tried to feed H., Weintraub said, his mother would say that something was hurting him and that he shouldn’t be fed. At this stage they still believed her, because nobody wanted to think that a mother would harm her child.

    The doctor even demonstrated, using a doll, how the mother would disconnect the feeding tubes from the child, though only the medical team was authorized to do this. The boys’ uncle, the doctor said, related that he had seen the mother’s hands under the blanket and the boy screaming in pain. At this point it was decided to take the boy under medical supervision.

    “We were concerned that the mother would decide to take him to another hospital, so we reported the incident,” the doctor testified. “She strongly opposed and was furious that we moved the boy to a room closer to the nurses’ station.”

    Weintraub emphasized that on the day the mother was kept away from the ward, the boy’s skin condition disappeared, and his skin cleared up completely.

    “When the mother wasn’t around, the boy slept soundly and no morphine was required,” he said. “When we kept her away from him, in less than a week we were able to stop the morphine completely, and the child got completely well and didn’t need any drugs.”

    Later, upon receiving further evidence, the possibility that he was suffering from his mother’s acts was raised. It was also suspected that the mother suffered from Munchausen Syndrome by proxy, in which a parent causes marks of illness on the child.

    The mother’s legal defense tried to persuade her to accept the plea bargain, according to which she would admit to most of the paragraphs in the indictment and would thus avoid jail.

    On Thursday morning, she was still refusing the agreement in accordance with instructions from her rabbis, but after the doctor’s testimony the two sides requested a break in the proceedings because they were close to reaching a plea bargain.

    It should be noted that the conditions for her detention and what access she should have to her children during the trial have already been extensively discussed. At the same time, the haredi population has held ongoing and sometimes violent protests against her arrest.

    District Court Judge Moshe Ravid eventually ruled that the mother should be kept away from Mea Shearim, the ultra-Orthodox neighborhood in Jerusalem, together with her children – excluding H., who was the victim of her abuse – and that she would be held under house arrest with 24-hour surveillance.

    All appeals by the prosecution against this ruling were rejected. The replacement of the mother’s defense team also resulted in delays to the trial.

    Outrage at Deal

    Children’s rights activists and organizations expressed outrage on Thursday over a plea bargain struck between state prosecutors and a mother from Jerusalem charged with knowingly starving her young son.

    According to the deal, the mother will confess to child abuse offenses and evade a prison sentence. She will be barred from having custody of her children for five years, during which time she will be able to meet with her children during supervised visits.

    The plea bargain must receive approval from a Jerusalem court on Monday before going into effect.

    “This is an outrageous plea bargain which has resulted in an outcome that is lenient in the extreme for the suspect,” Dr. Yitzhak Kadman, Director of the National Council for the Child, said in a statement on Thursday. “It seems that the blood of children in Israel is horrifyingly cheap,” he said, warning that the bargain sent a dangerous message for potential future child abusers.

    “State prosecutors would not dare make such a shameful plea bargain in other offenses, even offenses considered lighter than child abuse,” Kadman added.

    Kadman lamented the common use of plea bargains in settling child abuse cases, noting that 80 percent of such charges result in plea bargains, and called on courts to reject them.

    Responding to the fierce criticisms, Jerusalem State Prosecutor Tal Weisman said that the arrangement was guided mainly by a “a concern for the welfare of the mother’s children.”

    “The suspect has six children and suffers from a serious disturbance,” Weisman said, adding that the plea bargain would ensure that the mother’s contact with her children would be supervised and monitored by Social Services for years to come.

    As the debate raged on Thursday, Haredi Rabbi Avraham Froilich, who has maintained along with members of the haredi community in Jerusalem that the mother is innocent of all charges, called on her not to sign the plea bargain.

    Sine no one would not accept a plea bargain if there would be such solid evidence.

    This is life for a mother not to see her children the problam was she tried to fight the hospital herself she souldof take a big law firm abd pr company and sue the h… Out of them instead the hospital started a majer compain to smear her all over the place like all child melastor and abusers are doing.

    she is now better off to admit to this false story. In order not to go thru the whole legal show. So she should not sit in jail for nothing, and this is a scary lesson for us that sometimes in situations people have to admit to false allegations in order not to go thru years of hell. So there should not be an excitement against our community how cruel we treat our kids cause she admitted to stir false allegations!

    she is lucky to escape a jail sentence. This was a horrible story and her son should have a complete recovery both physically and mentally.. I think the Court has been very lenient towards her.I sincerely hope the Charadim don’t start demonstrations again.

    personally i always thought she was guilty!!nobody thats as sick as she claimed her son was gets automatically better after her being outa the equation for a week!!!!the people who protest against her owe some appologies!they should make sure they know that these things could and do happen even unfortunately in the frummest households!she is not well and instead of protesting that she is mayb they should put ther energy in2 getiing her the best help available so these poor children can have a normal mother!

    Why aren’t they behind bars if they stuffed him with chemo for no reason other than for experimentation causing his hair to fall out?

    All those who jump to knee-jerk conclusions and rush to vindicate Hadassah completely, should think again. Do you really think that you already have heard the whole story: Don’t believe it for one moment!! What is a private citizen, a mother of young children supposed to do: Continue fighting against the “Huge Machine?!”

Foe an entire year nothing was suspected against the mother, after a year when the mother realized they were experimenting on her little soul, she wanted to switch medical center, as the hospital was concerned that this will leek out they started the accusions!! HADASAH is known for this!!! הדסה הצמאה לדם!! Who would You rather believe? A secular man who’s not observant and cares for NOTHING? Or a shomer torah??? The truth is obvious!!     I was shocked when it was just reported that the mother turned down the plea.I was wondering didn’t she know that just about every chareidi ans settlers.Like the 2 poor brothers in gush katif who wound up in jail,even though the idf testified on their behalf.B”H,i see she had sechel.

    A woman that is prepared to kill or make terrible suffering to a child cannot
    be the real mother as history proves with king Solomon’s verdict. They should check if the DNA of the boy matches the father and mother and then
    we will be all a tiny bit smarter. If this problem would have come before

    All of you anti-demonstration hecklers have very selective short term memories. While the hospital may be right that this woman is ill, how does that translate into a PRISON SENTENCE?! Does a mentally-ill woman necessitate a sting operation involving 10 riot policemen to arrest her in full view of her entire community? Answer these questions all you Anti-Charedi racists. Our brothers in Meah Shearim are using the only language that their government understands. Get off your high-horses and go to Eretz Yisrael. See how far you can get with “peaceful dialogue”.

    I hope one day all you people who believe that she actually commited at the crimes which she pleaded guilty for will one day be in the same predicament.
    Unfortunately, people sometimes choose the lesser of the evil. It is very difficult to get out of the clutches of the legal system. The Doctors, the nurses, the prosecutors would never admit and cannot afford to be proven wrong. They can torture her with long drawn out court proceedures, they have no problem getting false witnesses.
    Her defense lawyers know what she’s up against, and unfortunately, she was better off pleading guilty…What a tragedy!
    They have suceeded to ruin a family—Didon Notzach!

    this just proves that they know the whole thing is completely implausible, otherwise they would never let her off the hook. Good for her that she made a clever decision to avoid jail which would be a terrible place for a frum woman, and those that believed her innocence will continue to do so, knowing that the admittance was just to avoid jail, and those that believe the admittance are the one that anyway didn’t believe her innocence.

    As usual, the typical slugs come out of the wood works to attack anyone more to the right than they are. The least they can do is get their facts straight. The protests (which I do not support and I think were ill advised and stupid) were not to assert this woman’s innocence. They were protesting that this woman was treated as a common criminal (by Israeli standards – in the U.S. that treatment is limited to terrorists) when if the allegations were true she should have been hospitalized and made to undergo treatment.

    Kol hakovod to the court, lawyers and all involved for reaching this outcome and taking the children away from this sick woman for at least 5 years. There should be an established procedure in all these cases to remove children from any household where there is even a suspicion of child abuse before any trial. We would be much better off riskiing some near-term disruption of a family versus c’v leaving the child exposed to abuse and life-threatening injuries or harm.

    Munchausen is a condition that falls under the broader category of malingering. these are usually diagnoses of exclusion. That means other things have to be ruled out before one is labeled Munchausen…

    To all of her defenders, shame on you. My mother had Munchausen syndrome by-proxy, and I suffered for many years! THe mother usually picks one child, and keeps them thinking that they are sick. The mother will do whatever she has to do to get that satisfaction of having people feel sorry for her! I had to be in the hospital for months and months, and my mother didn’t even visit because she was getting too much hanoah getting rachmunis from others who heard about it!
    It’s a terrible disease, and the people who have it don’t always know what they’re doing, but it seems that this woman clearly knew.
    She’s only been offered the plea deal so the charedim don’t riot!

    Her children deserve the best care.
    For Rabbis in Meah Shearim to encourage her to avoid the truth of the circumstance behind the injuries and maltreatment of her child is criminal in the extreme and is a Chilul HaShem of the highest order.
    The same Rabbi encourage bochurim to be violent and destructive at demonstrations.
    I t is no wonder that many in Israel are sickened by their antics

    Why has no-one brought the fact that in February this mother gave birth to a healthy child – Boruch Hashem – but unfortunately as a result of the epidural she was left with a spinal disorder and presently she is still unable to walk or get around. How much more can she take. I would suggest that we all daven for her gesund! Any idea of her full name?

    To those who say that the mother is suffering from a mental disease:
    Why was she treated like a criminal?
    Are people with a mental condition responsible for their actions?
    If the accusers, doctors, prosecutors, would have acted all along with consistency and justice, their version would sound more plausible.
    However, if doctors agree to throw a pregnant, mentally disturbed woman, into jail, her feet tied together with shackles, it raises questions about the validity of their testimonies.

    My son shared a room with this child and I alerted the hospital to issues long ago, when Chaim was only 2 and a half. The hospital is guilty of ignoring the problem until it got to the point of threatening his life. There were warning signs and blatant abuse happening well before then.

    It was a joint problem, the mother abusing her child and the hospital ignoring it.

    This whole situation was so horrific that I cried at the nurses and made them change my son to a different room so I wouldn’t have to witness the abuse. I have been davening and crying, both for the child and the mother, since we crossed paths.
