    New York – “A chorus of black commentators and civic leaders has begun expressing frustration over (Elena) Kagan’s hiring record as Harvard dean. From 2003 to 2009, 29 faculty members were hired: 28 were white and one was Asian-American.”

    CNN pundit Roland Martin slammed “Kagan’s record on diversity as one that a ‘white Republican U.S. president’ would be criticized for.”

    This is an excerpt from the Washington Post about the rising anger in a black community, which voted 24-1 for Obama, that one of their own was once again passed over for the Supreme Court.

    Not since Thurgood Marshall, 43 years ago, has a Democratic president chosen an African-American. The lone sitting black justice is Clarence Thomas, nominated by George H. W. Bush. And Thomas was made to run a gauntlet by Senate liberals.

    Indeed, of the last seven justices nominated by Democrats JFK, LBJ, Bill Clinton and Barack Obama, one was black, Marshall; one was Puerto Rican, Sonia Sotomayor. The other five were Jews: Arthur Goldberg, Abe Fortas, Ruth Bader Ginsberg, Stephen Breyer and Elena Kagan.

    If Kagan is confirmed, Jews, who represent less than 2 percent of the U.S. population, will have 33 percent of the Supreme Court seats.

    Is this the Democrats’ idea of diversity?

    But while leaders in the black community may be upset, the folks who look more like the real targets of liberal bias are white Protestants and Catholics, who still constitute well over half of the U.S. population.

    Not in living memory has a Democratic president nominated an Irish, Italian or Polish Catholic, though these ethnic communities once gave the party its greatest victories in the cities and states of the North.

    What happened to the party of the Daleys, Rizzos and Rostenkowskis?

    And not in nearly half a century has a Democratic president nominated a white Protestant or white Catholic man or woman.

    The last was Byron “Whizzer” White, the all-American running back from the University of Colorado, nominated by his friend Jack Kennedy. White cast one of the only two votes against Roe v Wade.

    What of the record of Republican presidents?

    Richard Nixon and Gerald Ford made seven nominations. All were white Protestant males: Warren Burger, Clement Haynsworth, Harrold Carswell, Harry Blackmun, Lewis Powell, William Rehnquist and John Paul Stevens.

    The diversity Nixon sought was first to put a Southerner on the court. He succeeded in his third try, with Powell. And he sought to put the first woman on the court, but pulled back from nominating Judge Mildred Lillie of California when the American Bar Associated rated her unqualified.

    With Ronald Reagan and Bush I came Republican diversity.

    Reagan’s first choice was Sandra Day O’Connor, the first woman ever nominated. His second was Antonin Scalia, the first Italian-American. When his third nominee, Robert Bork, a Protestant, was rejected, Reagan chose Bork’s Jewish colleague on the U.S. Appellate Court for the District of Columbia, Douglas H. Ginsburg. When Douglas Ginsburg was pulled because of a marijuana incident in college, Reagan chose the Irish Catholic Anthony Kennedy.

    George H. W. Bush picked David Souter, a Protestant from New Hampshire, and Clarence Thomas, the second African-American to sit. George W. Bush chose John Roberts, a Catholic; Harriet Miers, the first Evangelical Christian of our era; and Sam Alito, the second Italian Catholic.

    If Kagan is confirmed, the Court will consist of three Jews and six Catholics (who represent not quite a fourth of the country), but not a single Protestant, though Protestants remain half the nation and our founding faith.

    If Kagan is confirmed, three of the four justices nominated by Democratic presidents will be from New York City: Kagan from the Upper West Side, Sotomayor from the Bronx, Ruth Bader Ginsburg from Brooklyn. Breyer is from San Francisco.

    What kind of diversity is this – either in geography or life experience?

    While Sotomayor went to Yale Law School, the other three liberals went to Harvard, though Ruth Bader Ginsburg graduated from Columbia. Seems a fairly narrow range for a party that once claimed to be America’s party.

    Ruth Bader Ginsburg tied for first in her class at Columbia, but neither Obama nominee is academically distinguished. Sotomayor called herself an “affirmative action baby” who, at Princeton, was urged to read children’s books in the summer to improve her reading and writing skills. Kagan never served as a judge, never litigated a case before being named solicitor general, never wrote a book or anything else anyone has turned up that manifests real legal scholarship.

    From her Princeton thesis on the sad demise of 20th-century socialism, to her tears at the defeat of the radical liberal Senate candidate Elizabeth Holtzman in 1980, to her hostility to the U.S. military on the Harvard campus while dean of the law school, Kagan has revealed herself to be one more Ivy League leftist anxious to use a lifetime seat on the court, winning the plaudits of her peers by imposing her ideology on a nation that has never voted for it.

    Conservatives will not soon get another opportunity like this to take down Ivy League pretensions to represent and rule America.

    Says more about Pat than anything else. But it’s nothing we didn’t already know.

    He is a bigot, we know that.

    But as Jews we need or want her up there like a whole in the head. It just feeds in to people like Buchanan’s bigotry and, frankly, what benefit is it for Jews? Does she even represent Jewish values?

    Meanwhile, Obama benefits because (just like Rahm and Axelrod) he gets to pursue his anti-Israel policies to the max while saying: “Look, I nominated a Jew to the Supreme Court! My closest henchmen are Jewish!”

    an interpretation of the law. It is not representing a group, blacks don’t go for blacks and jews don’t go for Jews. These are people who have demonstrated the ability to understand the law and set precedent for the future.

    It is not an easy job, it is only 9 on the bench, they are given this job for life. we cant be politically correct and bring on another black guy. Trust me if r there was someone who was even half capable of the job Obama would bring him on. as far as ethnic and minority are concerned sotomayor and blacks are the same grade. the pro unions state worker jobs, should be happy they got thier fix with Sotomayor.

    an excellent point: It’s absurd to complain that Jews make up 33% of the SCOTUS and only 2% of the general population. That’s comparing apples to oranges.
    The right question is, what percentage of the Jewish population is in the legal profession? I don’t know, but I
    guesg guess that it would be much, much higher than 2%, maybe even close to 33%. It probably has something to do with the legacy of the Talmud, just as I believe that the legacy of the great Mainmonides has something to do with the large number of Jews in the medical profession.

    Though Pat is known for being no friend of the Jews, I see his point in this instance. It is adisgrace to have the supreme court with 33% jewish and 33% from NYC. It’s supposed to be somewhat representative of the people. Imagine if 33% of the senate came from NYC?!

    Buchanan can’t even stick to facts. Far from being academically undistinguished, both Sotomayor and Kagan graduated *summa cum laude* from Princeton.

    Pat Buchanan is no friend of Israel or the Jews, but in this case he is 100% correct. There is nothing anti-semitic in Buchanan’s argument that the Supreme Court should not consist of three leftist Jews and six Catholics.

    The last thing the Jews need is another corrupt Jewish leftist on the Supreme Court. Kagan’s presence on the Court will greatly reinforce the stereotype of Jews as being immoral leftists who are pursuing policies which undermine the moral and social fabric of America.

    In this case the charge of anti-semitism against Buchanan is a bogeyman designed to distract Jews from the real issue of the virulent leftist corruption of the Jewish “leadership”. It is the corrupt anti-Torah values of Kagan and her ilk which are stoking the flames of antisemitism in America, not the Pat Buchanans.

    Again, people cannot understand basic English. The issue is not that Buchanan said there were “too many Jews” on the Court. He wants to know why when 75% of the country are Protestants there is not even ONE Protestant on the court, just 3 Jews and 6 Catholics, and Buchanan himself is a CATHOLIC! And I am a JEW and I agree with him!

    Buchanan left the Republican party many years ago and remains officially “unaffiliated” as most members of the media are. However, he makes it VERY clear who he votes for and supports in elections and it is ALWAYS the Republican.

    Buchanan is not an antisemite but at the same time he is not afraid of “third-rail” subjects when it comes to matters of race, culture and religion.

    I have personally heard this same conversation on on both FNC and MSNBC. The question is not whether Jews have too much power, or that there are too many Jews on the court. The question being asked, rightfully, is whether the court accurately represents the people of the USA. Obviously, from a cultural and religious standpoint, the answer is “no”. But, does that matter? It is certainly reasonable to debate whether that has an impact on the court. I don’t see the problem here at all. I see liberals making a mountain out of a molehill.

    Yes it does because the philosophy exposed by Alito, Roberts, Thomas and Scalia is not the majority of the American public. Certainly the only Afro-American Judge is not a mirror image of the black pupulation and finally there is a Judge of Hispanic origin.

    The beauty of this country and greatness is to me that I a survivor from concentration camp, an orthodox Jew worked for forty years in a responsible position for the U.S. government a fact even before Hitler was in Austria. Exemptions were made for my religous observance and I received a number of awards and one the first speaker at a agency sponsered holocaust observance. Despite the beliefs exspressed on this website this country is composed of atheists, protestants, catholics and jews and the art is to create a functional goverment which allows expression of all the above groups. Lucky for me that the founding fathers of this country were deists and not staunchly religous people as exposed on this website.

    Since it is a given that Obama is going to nominate a liberal for Supreme Court Justice anyway, what is so terrible that the liberal that he does pick is a Jewess? Do Jews still cherish the old shtetl mentality of “What will the goyim think?” And such a goy as Buchanan, oy vey! Stop me if I’m wrong, but did Pat Buchanan ever complain that of the 44 Presidents of the U.S. that America has had, that not one of them was a Jew? Or, for that matter has Pat Buchanan ever complained that of the 48 Vice Presidents that we have had, that not one of them was a Jew?

    Patty Boy, you have the mentality of a two year old. Torah and Talmud have been imbueing the Jewish people for three thousand years with wisdom. The Jewish mind even secular can’t help from absorbing this phenomenon. Just like other races absorb certain qualities that are perpetuated in their genes. Ask instead why Western law is based on the Talmud. Ask why your religion is based on Judiasm. Ask why Jews who you point out are a minority aren’t considered a minority in any federal, state or local affirmative action granting commissions or priviledges to minorities.     I am Jewish and I agree with his point. The Democrats take their constituents for granted. This administration is academically elitist and too far left. He is saying that this in not the party of the people as they feign to be. Both Obama’s picks are marginal and neither is qualified for the highest court, but their idealogy works and they are lefties who will get by without opposition.
