    Chief Justice John G. Roberts Jr. administered the oath at the Supreme Court just two days after the Senate on Thursday voted to confirm her nomination by a 63-37 margin and one day after President Obama hosted a White House reception in Kagan’s honor.

    She is not expected to dramatically change the ideological balance of the court because she replaces retired Justice John Paul Stevens, a fellow liberal jurist. But her installation marks a historic demographic milestone. Women now make up one-third of the nine-member court, as Kagan joins Sonia Sotomayor and Ruth Bader Ginsberg as associate justices. The first and only other woman to serve on the court was Sandra Day O’Connor, who served from 1981 to 2006.

    At Friday’s reception, Obama said that the addition of another woman ensures that the court will be “a little more inclusive, a little more representative, more reflective of us as a people than ever before.”

    However, with Kagan — a Jewish lawyer who studied at Harvard Law School — the court becomes more homogeneous in other ways. It now no longer has a single Protestant and all nine justices have been trained in the Ivy League.

    Having served for the last year as Obama’s solicitor general, Kagan has been the government’s chief lawyer before the court. At the White House reception, Kagan told her Justice Department associates not to expect her to be a rubber stamp for the administration.

    “Once I put on that robe, I’m only going to vote with them when they have the better of the argument, which — let’s be frank — is not in every case,” Kagan said to laughter.

    Kagan is expected to recuse herself from deciding several upcoming cases before the court because she participated in preparing the government’s position.

    In Saturday’s low-key ceremony, Kagan first took a constitutional oath – which is administered to all federal officers. In a second judicial oath, she swore to “administer justice without respect to persons, and do equal right to the poor and to the rich.”

    In an ornate courthouse conference room full of family and special guests including five justices, Elena Kagan was sworn in Saturday as the 100th Associate Justice in Supreme Court history. Kagan, 50, did not say anything except for the words of the oath that was administered by Chief Justice John Roberts whom Kagan now supplants as the court’s youngest member.

    In that oath Kagan swore to administer justice evenly to rich and poor alike and follow the Constitution. It’s an oath that all justices take but was actually the second one Kagan took Saturday. Just a few minutes earlier in a different room Roberts administered the oath given to all federal employees.

    Kagan’s two brothers, Marc and Irving were seated in the front row of the room along with other family members. Justices Anthony Kennedy, Clarence Thomas, Ruth Bader Ginsburg and Sonia Sotomayor were also in attendance.

    During the oath, Kagan placed her left hand on a Bible owned by Justice Stephen Breyer. It is the same one that he used in his ceremony in 1994 and was also used by Kagan last year when she took the oath to become Solicitor General. Breyer and Kagan are each Jewish, as well as, Justice Ruth Bader Ginsburg. The other six justices are Roman Catholics which makes this the first time that no Protestants are on the bench.

    The ceremony was nearly identical to the one that took place a year ago for Justice Sonia Sotomayor and must have surely pleased the man Kagan replaces, retired Justice John Paul Stevens, who criticized the decision of some justices to be sworn in at the White House. Stevens was also in attendance Saturday.

    The ceremony took place in one of the court’s ceremonial conference room. A portrait of former Chief Justice Charles Evans Hughes (1930-1941) looked directly over the proceedings.

    Kagan’s arrival comes during the court’s summer recess. This gives Kagan, who has never been a judge, time to acclimate to her surroundings and hire staff to help her prepare for the high court’s upcoming term. There are already hundreds of cases pending on the court’s docket awaiting a decision from the justices to grant further review. There are also a dozen cases that have already been scheduled for the court’s October sitting but Kagan has announced that she will not take part in three of them–including the first of the term–because of her work as Solicitor General.

    This is a great honor for all yidden America and we should daven that hashem give her the wisdom to make the right decisions in the many important issues that will come before the court during the 30 years or so she will be a judge, Much mazel and hatzlacha to Madame Justice Kagan, the newest of a growing list of ehrleche yidden who have served on our nation’s highest court.

    You are probably one of those naive posters who complained about the clinton chassinah last shabbos. Justice Kagan is not shomer shabbos and she wanted to be sworn in asap so she can vote on matters that may come before the court between now and the October start of the new term. Chief Justice Roberts leaves on Sunday for a vacation with his family so today was a logical day.

    Says serves up his usual krumkeit when she violates the Shabbos to finalize her selection.

    Unfortunately true Judaism and her are strangers. Her ultra Liberal presence on the supreme court will cause her to work against true Jewish values. We should pray to be saved from her and other abandoners of Torah.

    There is nothing I despise more than traditional/religious Jews, who should know better are still under the impression that when a secular Jew reaches a
    Certain level in society, such as public office or extreme wealth and fame, that this is somehow a Jewish thing we should be proud of.
    These talentes people, who just happen to be Jewish, these people have absoloutly no connection to our traditions or values. In fact it is usually the opposite. They are usually leftist liberal loonies who value everything that is anathema to us.
    To this intelligent, succesful lady Shabbos etc means as much as kwanza does to the majority of readers of this fine Blog.

    I just don’t understand any of you complainers, why shouldn’t she take the oath on Shabbat, it is permitted, as a matter of fact your hero Senator Liebermann votes on Shabbat, when important issues come before the Senate. The only reason you criticize Justice Kagan because she is a liberal.

    Poster # 1 was “Tongue in Cheek”. You can read it between the lines. As for being proud of another Jewish justice on the Supreme Court. She wasn’t picked by President Obama because she’s Jewish. The reason she was picked was because she’s an ultra liberal (and an efficient lawyer) and will further his agenda in reshaping the makeup of the Court. I have a hunch that we will still suffer plenty of embarrassment because of the controversial decisions of this “Jewish” Justice.

    I hope she was using a Tanakh (whether in Hebrew or in English) and not the King James Bile (it contains the “New” Testament).

    While she is not frum it’s still a shame that she did this on Shabbos. Sometimes we represent something beyond ourselves even when we don’t want to do so.
