    Kiryas Joel, NY – Three school districts want a court to force New York state to let them collect millions in Medicaid money for services to children with disabilities.

    The Kiryas Joel, Washingtonville and East Ramapo school districts filed a joint claim, asking a court to stop the state from barring collection of more than a year’s worth of reimbursements. At issue are repayments for services such as speech pathology and psychological counseling for Medicaid-eligible students with disabilities. The petition was filed in the state Supreme Court in Albany County.

    The state told districts in July 2009 that it was freezing payments for the School Supportive Health Services Program while it worked out new rules. Earlier that month, the state settled a longstanding face-off with the feds.

    The federal government claimed that for more than a decade New York failed to appropriately administer its programs, causing improperly documented claims and bad payments. The settlement included a record $540 million payment by the state and a compliance program.

    The court’s ruling could impact every district in the state, said the plaintiffs’ attorney, Mark Rushfield, of Shaw, Perelson, May and Lambert.

    Its time to reduce or eliminate ALL of these subsidy and grant programs, not just for frum communities but across the state. The government is broke and these jokers are going to court saying give us MORE.

    I must have read a different article than you did.
    People with disabilities are entitled to certain services under medicaid. That is the law anyplace in the USA. It seems the feds had some issues with NYS documentation so they just stopped all payments to all districts in NYS. I am not aware of which part of this is a subsidy or grant. In addition, law requires services must be continued even though the feds mandate the services but temporarily stopped paying.

    I am not sure whom you are calling jokers; there is nobody it applies to better than someone that posts with apparently no knowledge of the issue and no signs of having read the post.

    You have it right.
    the Services for these kids Must be provided fully & the State is responsible for the payments.

    Now if the state wants to stop the therapy. The must send a written letter (which they don’t want to do) that this child will not get paid & the providor should stop the service.
