It certainly appears that way after the Borough Park Democrat unveiled a bill to prevent legitimate businesses like this newspaper from informing the public — a bill he wrote after his mother got a ticket for having an unclean front yard.
Mamaleh got the ticket because a gust of wind blew an advertising circular into her yard and she wasn’t there to clean it up before a Department of Sanitation enforcement officer happened by.
Days later, her good son proposed the legislation, which would “make it illegal to distribute unsolicited materials, fliers, and circulars to any property that posts a sign indicating that it doesn’t wish to receive them.”
Under Felder’s bill, the city would distribute “No solicitation” signs to property owners all over town — standardized decals similar to the recycling stickers that the Sanitation Department hands out to plaster on your garbage cans.
It sounds good on paper, man — but not to this paper man. Felder’s bill is so riddled with flaws — some of them big enough to drive a First Amendment through! — that I almost don’t know where to start. [brooklynpaper]
I stand by the gist of what I said, but I’m retracting and apologizing for the gratuitious insults.

I resent these fliers on my property, and anything to help is greatly appreciated.

Now please try to get the drivers to stop passing red lights, stop talking on the cell phone while driving, and stop passing school buses.

Let me get this straight. A writer for a local paper which no one would pay a nickel for, but is distributed free, has the gall to write this preachy editorial about this issue? Ever hear of conflict of interest, bozo? Way to go Simcha!
If there are flaws in Felder’s bill, I’m sure they can be corrected.
I for one am in favor of the “ikor” of the bill. Is it not an infringment of my privacy when flyers are shoved under my door? Or when the entrance to the apartment house is so littered with flyers you can slip on them.
We are allowed to be put on a “no call” list for phone calls, what’s the difference here?

you are ALL right!!! ban the flyer distributors, ban the tickets (in certian areas and applications) and stop knocking those who are trying to save a jew a buck from todays miney hungry, corrupt government. bloomberg was NEVER poor and doesnt know what it feels like to have to scrounge pennies to pay for food, let alone rent, utilies, etc… PLUS TUITIONS.

I have one very simple stupid question to ask. How would this bill prevent a circular ad from being pushed by the wind into Mamaleh’s front yard? Isnt that why she got the ticket? Or so she/he claims. Unless of course, the wind never pushed anything but she simply did not clean up her front yard. Huh, any thoughts?
That’s right, I live across from a school and there is always litter (soda cans, coffee cups, cigarette butts, candy wrappers) flowing onto our sidewalk, and also the two neighbors on either side of us.
All this together with the trash the good sanitation guys leave behind in the street, in the trash cans, and on the sidewalks (that they can’t bend down to pick up when it drops)!
I don’t like unsolicited telephone calls trying to sell you something, or those ridiculous recordings about frum clothing store sales, melava malkas, chinese auctions et al. Not to mention the cars going around with loudspeakers trying to getyou to come to some event or other. We all read the newspapers and can decide for ourselves if we are going!
And now how to get rid of the unsolicited flyers strewn in front of our homes. Who needs them?
We might as well give up our jobs to stand guard outside our homes to keep them clean!!
So the writer of the article gives not one example of the flaws that it is supposedly riddled with. I respect his right to write stupidity, but if he/she intends to muster support, its time to start giving reasons.
How about rather than limit the flyers, limit the sanitation’s ability to write tickets. The burden should be put on them to prove that you littered, there should be no tickets on windy days, and there should be no fines for naturally occurring litter like leaves. Also, anyone living within 200 feet of a public thoroughfare, like a school, shul, bus stop, train station, shopping district, should be entirely exempt, as the garbage is generally not theirs.
Years ago they would deliver the flyers to the doorstep – now they just throw them on the sidewalk in front of each house. I don’t see how the JC Penny or Sears ad constitues free speech. If it took a ticket issued to Rebitzen Felder to get this before City Council, it was a very worthwhile ticket.
