    Borough Park, Brooklyn NY – We reported here about the Boro Park attempted kidnapping story. Now, merely two days after a Brooklyn teen allegedly tried to kidnap a feisty 11-year-old who wriggled out of his grasp, the suspect was back on the street yesterday.

    Bernard Mutterperl, 19, of Borough Park, got out of Rikers Island shortly before 2 p.m., Correction Department officials confirmed.
    Before he was freed, Mutterperl told cops that “when he sees young kids, he has to go after them,” according to court documents.

    Xochil Garcia’s worried stepfather, Heriberto Rodriguez, said no one called the family to warn them Mutterperl was a free man.

    It was unclear who posted Mutterperl’s $25,000 cash bail. [nydailynews]

    11:48 – He wasn’t indicted. He posted bail to appear for any possible indictment pending charges after a grand jury decided whether or not to charge him.

    The police are doubting this little princess’ story. That is why he was released on bail, and why he wasn’t yet charged, and why you don’t see his photo.

    And how many innocent men have the media convicted and you never hear about when they are exonerated?

    Remember a few weeks ago a public school janitor was accused of molesting students in his school. After his arrest and the required perp walk with all the media present (and his name and picture plastered all over the media), it was discovered days later that the story was all made up by the alleged victim. Where does that poor guy go to get his reputation back?

    Sorry, plastering photos only occurs when someone who has been alleged of a dangerous crime is on the loose. Not, as you have indicated, when someone is charged with a crime.

Second of all, I have not been charged with any crimes and therefore no reason to plaster my photo anywhere.
    His photo has been withheld for some reason. Probably the same reason everyone here is so determined to defend this creep.

    You want to know why his photo is not plastered around all over? Because if that’s what they would do when someone says so, i would say that about you tomorrow and have your picture posted around all over.

    Again, I am grateful the little girl got away and was brave enough to do so. How smart to have a plan and be able to keep your cool enough to follow through with the plan. Shame on those of you accusing her of something improper. She is smart and confident. Good for her!

    What does not pass the smell test is that this guy was released on such low bail. What the heck is going on? Why isn’t his photo plastered all over like all alleged criminals? You don’t need to be proven guilty to have your photo or at least an illustration shown on the news or published in the papers. Something is very smelly here.

    I have no idea of the facts but one would hope there would be restrictions placed on him while he is out on bail.

    Just because he has not been tried does not mean he should be allowed to baby sit young girls right now.

    The point is the facts are unknown. You can’t hang a man on someones say-so.

    Don’t tarnish his name; don’t discount her charge.

    Let justice take its course. And let the truth prevail.

    That’s right; the girl made it up. Every teach your children about safety, and not letting strangers take you away. She had a plan. Maybe someone she knows who was abused and so she had a plan. Of course the 11 year old made it all up. Let the criminal go scott free. All you bloggers you know that kids are always making things up. All the molesters in jail are only there because KIDS make up stories.

    I wouldn’t accept as factual an anonymous quote from the news media. The media has frequently in the past embellished stories with fictitious anonymous quotes.

Some factors judges generally use in determining whether or not to free the alleged criminal on bail are the danger he/she poses to the public, any history of alleged criminal offenses, the nature and circumstances surrounding the alleged offense and others.

    He is innocent until proven otherwise. That is the law in all civilized societies, as well as in halacha.

    Bail cannot be denied by law if he is not a convict.

    This story does not pass the smell-test. Read the AMNY article on it from yesterday. This kid said she had a plan in advance in case someone tried to rape her. And she otherwise appears way to smooth for an 11 year old ”victim.” There were no witnesses.
