    Bernard Mutterperl Borough Park, Brooklyn, NY – The Brooklyn families on edge after hearing that a judge allowed bail for a hulking suspect who allegedly tried to abduct an 11-year-old girl can breathe a little easier now – at least we know what he looks like.

    DA Charles Hynes defended his office’s controversial handling of the bail argument at Mutterperl’s arraignment last Monday evening.

    Hynes’ prosecutors asked for just $10,000 to insure the young man’s return to court. Mutterperl’s lawyer suggested bail of $4,500.

    According to transcripts, Judge John Wilson took the matter into his own hands, noting, “Unfortunately, I disagree with your suggestions.” He then set $75,000 bond or $25,000 cash – even though the suspect allegedly told cops that “when he sees young girls, he has to go after them.”

    “I didn’t get this job by a want ad,” a characteristically prickly Hynes saidt. “I’m a criminal lawyer and that was an appropriate bail. The judge decided that 75 over 25 was more appropriate. I don’t quarrel with that at all.

    “Bail is for the purpose to ensure that people come back. If the grand jury indicts for attempted kidnapping, it’s perfectly appropriate for us to ask for an enhanced bail, and we will.” [nypost]

    6:54 – What are you going to do if your next door neighbor robs your house? You’ll worry about it if it ever happens. Until then you’ll have more realistic worries.

    I’d be more worried about ruining an innocent mans reputation, than be worried about not ruining a guilty man reputation.

    And since this whole case stinks to high heaven with all the markings of a hatchet job on him, I don’t think you have anything to worry about.

    I know the person, he is one of the nicest people I know. In my OPINION he is not capable of doing such a thing. You will see the truth will come out, and the girl’s family or the media won’t even offer an apology.

    After reading and watching this prima-donna making it on the TV circuit, I realize that “something is rotten in the state of Denmark” to quote Shakespeare. And it is not the “alleged perp.” It is the “alleged victim.”

    She is going on all the TV talk-shpws, happily parading around the news cameras; next thing you know she will be selling the book and movie rights to her “story.”

    Way too slick for someone, esspecially starting all this within a day or so of her alleged victimhoodness.

    And as you said, who even knows if in the past he committed such crimes? Why allow the criminal justice system to take its course, when it is so much easier (and feels so much better) to just hang him in the media now?

    Thank you VIN for publishing the photo. I don’t understand the desperate need for the commenters here to defend this guy, down play the entire event and to criticize the victim. I wonder how many times he has done this in the past and gotten away with it? “He isn’t even facing any sexual related charges” – one commenter says. I guess we should let this guy go free so he can work his way up to sexual assault? Child molestors test the waters slowly to see what and how much they can get away with. Perhaps we have stopped this molestor before he had a chance to sexual molest/assault a child.

    11:17 – The Post said he has no criminal history.

    The media doesn’t much care regarding his side of the story. It doesn’t sell too many papers.

    For some reason the New York Post has featured this story, which is based only on the girl’s accusation. Keep in mind this young man has no record and no witnesses other than the accuser. I think she made up the story, but we will see. He at least has a good lawyer, Leo Kimmel representing him.

    This story is such BS. If you watch the girl being interviwed by cbs2ny.com you will see she was laughing through the entire interview. Being a police officer for 13 years I have never seen a 12 year old girl who says this was so “scary” and almost being “kidnapped” laughing.

    ALL victims of this nature are traumitized and not gitty during an interview.

    Also this young girl contradicted herself twice by stating she was followed upstairs and then later in the interview stating she was grabbed from behind. The story does not add up and this is why the D.A set a very low bail. Even the D.A does not believe the story at this time. There is no evidence of any crime. Also some idiot was quoted that this defendant stated he loves going after girls or soemthing to that nature? Give me a break! A criminal of this nature would never be so stupid and make a comment like that especially in front of us. Again, being a police officer for 12 years and now a detective for 3 years I do not think this guy is guilty of anything and I’m sure there is something more we do not know about.

    The only question I have is what was he doing in the building altogether? Maybe the guy was collecting rent? Does this guy work for a real estate company?

    Maybe this girl mouthed off to him and he decided to “follow the girl” to her apartment so he can have a word with her parents and then she claimed all these allegations?

    Don’t hang people until proven guilty.

    while every one is right, there is no witness, nor a scratch, the fact remains that the guy said to police “I see young girls I need to go after them” this is documented in police records, not just as some have suggest here that its only an anonymous source said so.

    “There’s no witness that this guy grabbed the girl, except what the girl said,” Kimmel told The Post. “The girl was not injured. Now this big guy was grabbing her. I can see that she doesn’t have a scratch on her, if this guy is really after her.”

    NYPost: Currently, Mutterperl faces only charges of child endangerment, burglary and unlawful imprisonment in the May 13 attack on Xochil Garcia.

    So he isn’t even facing any sexual related charges. So much for those wanting to hang him already, let alone guilt.
