Brooklyn, NY – Suit by Student Against NYPD for Inflicting Hernia Hell

    30

Brooklyn, NY – A Brooklyn student is looking to put the hurt on the city after spending an agony-filled night in a precinct cell just one day after hernia surgery – minus his pain medication.

Simon Weiss, 22, said cops ignored evidence of his surgery when they arrested him on May 9 for possession of two Vicodin pills. Not even a call from his Beth Israel Hospital doctor – a police surgeon – could free him.
"They're not human," Weiss, who filed a $1 million notice of claim, said of arresting cop Jason Reynolds and others at the 70th Precinct.

Weiss, who attends Yeshiva University, and a friend were pulled over at Coney Island Avenue and Avenue O just after 3 p.m.
When the cops found the pills, Weiss showed them his bandages. His roommate even rushed to the precinct with a copy of the prescription – to no avail.
By midnight, Weiss, in too much agony to sit or lie down, was leaning against a cell wall and moaning for an ambulance. At 4 a.m., cops finally took him to Coney Island Hospital – where doctors treated him with Vicodin.

"Officer Reynolds had so many opportunities to release Simon," said lawyer Saul Bienenfeld. "The fact that he continued to keep my client in custody is egregious and warrants that he be censured."
Prosecutors dismissed the case. Sources said Reynolds denied that anyone documented Weiss' prescription. [NY Post]

10:09 AM: Whoa, calm down. You don’t want those few remaining brain cells to burn up over this. First of all, there are so many errors in your grammar it’s difficult to read without laughing: I’ll “shutup” if you shut up. And who’s “Dr. Orders”? Is he your brain surgeon?
Secondly, don’t accuse me of theorizing that he purchased the drugs off the street. I merely pointed out that prescription drugs are illegal under certain circumstances, and I listed as many of those circumstances that I could think of at that moment. I did this because some of the comments here clearly indicate that not everyone realizes that prescription drugs can be considered illegal. If you could read English, you’d see that my only accusation was that he may have got the pain killers from a friend or relative. And who among us hasn’t (at least one time) “borrowed” some kind of prescription drug from a friend or relative? I guess most of us are just lucky that we haven’t been caught, especially with one that is a controlled dangerous substance, as in this case. Because, I repeat, if you do get caught, it is illegal. That’s the point.
We’ll have to wait and see what happens. I read the story and have the same “facts” that you do.

FYI to anyone who flies: Any loose prescription drugs will be confiscated at airport security if they are not in a labeled container. (If they are found.)

10:33 PM – Yes, it is very painful, which is why I am wondering why he was out to begin with. Did your son leave his home the day after his hernia surgery?
Now for brain surgery: If it cured studpidity I’d suggest it for you so that you can learn to write in English.

    May 25, 2007 7:07 AM

Yes he did with the Dr Orders if you don’t know the fact why don’t you shutup? The pain is tolerable with painkillers that are the whole point. What do you think happened he bought it on the street from a low life like you? The fact is he had surgery and had a prescription as the story says and was sent to the hospital and was prescribed more of the same medication. I really hope they find your brain or is it the one they advertise in the drug adds this what happens to your brain with drugs

2:29 AM – Possesssion of prescription drugs are illegal unless you obtained them via a prescription. You can usually prove this by showing the bottle they come in with the patients name typed on the bottle. Or, if directly from a hospital, via the discharge documents. Even taking your mothers pain killers is illegal because they were not prescribed for you. Buying prescripton drugs off the street is a common occurance these days as well, and illegal too. Perhaps he didn’t want to pay for the prescription, so he got a couple pain killers from a friend or relative. That’s illegal.
Drug dealers don’t just sell heroin, cocaine, and marijuana. They also sell prescription drugs that are acquired in various ways

The cop did a good job. It’s against the law to be driving while taking ANY narcotic. PERIOD.

NYS law says anyone driving while under the influence weather from drinking alcohol or taking a narcotic may be arrested. END OF STORY. Are frum people always allowed to be different than everyone else?

HIPPA RULES explicitley deny anyone having any personal health information except to the patient.

The Law states that not even ones spouse can get health information .

So how did this friend get a copy of a script?

    Something is very fishy.

He had the surgery the day before this happened. How come he was able to sit in the car, but was in too much pain to sit in jail? So he made it through the night and morning with just the pain pills the hospital handed to him, and still had two leftover and still hadn’t filled his prescription?
Very suspicious story. Need more details. Some people try anything to get out of a ticket. Ask the nice folks in Lakewood.

The higher ups might be fine, but I experienced blatant anti-semitism at the hands of 70th officers. As expected they tried to cover up, but i had witnesses.

It is known that the 70th precinct has many officers that are good and unfortunately some that are bad. We hope to just have the good ones respond. and let the rotten ones rot.

    May 22, 2007 10:49 AM

The higher ups are only as good as the worst patrol guy they are willing to tolerate and protect.

I love how whenever a cop is caught committing a crime first it is denied by the brass and then they talk about ‘a few bad apples’.

Apples have no choice. A good apple cannot do anything if he gets packed in a box next to a rotten one.

NYPD officers have a choice and they virtually all choose to at best look the other way when one of thier own goes bad.

To pursue it would have involved considerable costs in time and money and I decided it wasn’t worth it, but maybe I should have and then this student would not have had trouble.

i worked with the police on a daily basis for over 20 years and have met my share of nice cops but most of the ones that are 10 year or less officers are concerning. every day another one arrested, telling lies excessive drinking and having mouths like toilets. thjese are our childrens role models. shame on us all for sucking up to them they are all fitting of esav sonei es yakov. it took me a while but now i understand why even 30 years ago they were called “pigs”

I personaly know the commanding officer & the executive officers of the 7-0 pct. And some of the other cops over there. It is a very friendly place to walk in. Very respectful to the community & allways working hand in hand. I find this story hard to beleave or some part of the story is missing. Let’s wait for all true facts come out & you will see how nice the 7-0 is!!! Please let’s not jump on unknown facts…..

    May 22, 2007 9:23 AM

For those of us with a short memory, this is the friendly and respectful precinct in which a man was tortured with the handle of a plunger stuck so far us his rectum that it puntured his bladder and severed his colon. If you think the guys who hate blacks enough to do this to a human being love us enough that they could not leave on of ours screaming in pain for hours you probably shouldn’t be allowed near a computer alone because you’d find a way to electrecute yourself.

Let me just say, having gone through the surgery myself, that the pain during the first few days post-op is quite intense. I can not imagine how unbearable this must have been for him.

Why did he not provide acopy of the discharge papers which would for sure had instructyions of taking the pain pills.

    May 22, 2007 7:22 AM

How do you know he didn’t?????

If the surgical wound wasn’t enough to prove he was two days post-op what makes you think these animals in uniform would have cared about discharge papers??

It is very possible that on release from the hospital, he was gaive a two day supply of pain pills to catrry him over untill he has gone to fill the presciption. That is how the roomate was able to get the script. Why did he not provide acopy of the discharge papers which would for sure had instructyions of taking the pain pills.

    Hey, Fishy,

maybe the problem is with the way the reporter got the story???

perhaps what he actually brought was the pill bottle.

    who knows.

“His roommate even rushed to the precinct with a copy of the prescription”.

How did the roommate get a copy of the prescription? You usually have to hand those in to the pharmacy. Did he go to the pharmacy and ask for a copy? I doubt the pharmacy would provide that to some one other than the patient. Or, did the patient make a copy of the prescription for some unknown reason? Sounds fishy to me.
