Newark, NJ – Eli Weinstein Indicted In $200 Million Real Estate Investment Scam; Faces More Then 100 Years In Prison

    The 45-count Indictment charges Weinstein, 36, of Lakewood, N.J., with one count of conspiracy to commit wire fraud, 29 counts of wire fraud, two counts of wire fraud while on pretrial release, one count of bank fraud and 12 counts of money laundering. Weinstein will be arraigned on the Indictment on a date to be determined.

    Weinstein was previously charged by Complaint on Aug. 12, 2010, along with then Manalapan, N.J., resident Vladimir Siforov, 44. Both defendants were charged with one count
    of wire fraud and Weinstein was charged with one count of bank fraud. Siforov, who remains a fugitive, is named in three wire fraud counts in the Indictment.

    “According to the Indictment, Weinstein’s exploitation of investors’ trust was so shameless he used doctored documents for properties he didn’t own – including in a town that doesn’t exist – and continued to commit crimes while out on bail,” said U.S. Attorney Fishman.

    “With promises of sound investments and charitable donations, he allegedly stole $200 million, spending freely on fancy cars, jewelry and gambling trips. And in using victims’ money to
    collect Judaica, Weinstein robbed from his own community’s present to stockpile artifacts of its past.”

    According to the Indictment and other documents filed in Newark federal court:
    From at least as early as June 2004 through August 2011, Weinstein, with the help of Siforov and others, orchestrated a real estate investment fraud scheme out of Lakewood that has resulted in losses to victim investors of at least $200 million.

    To induce victims to invest, Weinstein and others made various types of materially false and misleading statements and omissions. For example, Weinstein and others represented to
    victims that Weinstein’s inside access to certain real estate opportunities allowed him to buy particular properties at below-market prices. Weinstein and others also told victims that their money would be used to purchase a specific property, and the property would be quickly resold – or “flipped” – to a third-party purchaser lined up by Weinstein. Victims were also told that their money would be held in escrow until the closing of a purported real estate transaction.

    Weinstein bolstered his lies by creating, and causing to be created, various types of fraudulent documents, including “show checks,” which Weinstein led victims to believe represented Weinstein’s investments in specific transactions but were never deposited; forged checks, which had actually been negotiated for small amounts, but Weinstein altered to appear worth millions of dollars; operating agreements, which showed that victims had ownership interests in specific properties they did not; and various kinds of forged legal documents, including leases, mortgages, and deeds.

    Weinstein initially targeted victims from the Orthodox Jewish community, of which he was a member, exploiting his standing in and knowledge of the customs and practices of the
    community to further the scheme. Weinstein abused the community’s practice of engaging in transactions based on trust and without paperwork to obtain money from his victims without substantial written records. Weinstein would then falsely represent that specific real estate transactions existed, that the victims’ monies were used to fund those transactions, or that the victims’ profits from those transactions were being “rolled” into new investments.

    By 2010, Weinstein had tarnished his reputation in the community due to the massive losses caused by the scheme. In April 2010, Weinstein and others began soliciting victims from
    outside of the Orthodox Jewish community, whom they defrauded out of millions of dollars.

    Weinstein then took significant portions of his victims’ money, which had been provided for specific real estate transactions, and used it for other purposes he did not disclose to victims. These included funding unrelated real estate transactions in which Weinstein was engaged; paying prior victims; and making charitable and religious contributions which he used to elevate his reputation within the Orthodox Jewish community.

    Weinstein also used millions of dollars fraudulently obtained from his victims to fund his own lavish spending, including millions of dollars worth of antique Judaica and other artwork; a
    multimillion-dollar collection of jewelry and watches; gambling in Las Vegas and elsewhere; and his personal expenses, including millions of dollars in credit card bills, millions of dollars in
    legal bills, and luxury car lease payments. If convicted of the wire fraud charges, Weinstein and Siforov each face a maximum potential penalty of 20 years in prison and a $250,000 fine per count. If convicted on the wire fraud while on pretrial release charges, Weinstein faces a maximum potential penalty of 30 years in prison per count. Weinstein also faces a maximum potential penalty of 20 years in prison and a $250,000 fine on the wire fraud conspiracy charge; 30 years in prison and a $1 million fine on the bank fraud charge; and a maximum potential penalty of 10 years in prison and a $250,000 fine on each of the money laundering charges.

    He has made a chillul HaShem. He posed as Frum but never was. Of course the world at large will not make this distinction, so, his public shaming is a black eye for all Jews, not just the frum. Everybody, get it: no sin can be hidden anymore. Let’s stop protecting the evildoers among us. And let’s all clean up our acts.

    This is what’s wrong with our justice system;

    He defrauded some investors with 200m, what difference does it make how he did it. One would rather kill a person, its just one count.

    The Torah says, make him a slave, tops for 6 years. Ripping apart a family for “counts”.
    I know I am sticking up for the wrong side here, but this is outrages.

    I know what he did was beyond evil but it’s hard to see a frum 36 year old facing life in prison. I’m not saying it’s not deserved, just difficult to contemplate that sort of future for him.

    What does he have out of it now? Didn’t he know that eventually he will be caught? So he lived a lavish life for a few years in exchange of losing his basic freedom for the rest of his life. I always wonder what these people think.

    It is a very good day for Lakewood! The more we think we are above the law, the less civil we can become. Accountability for our actions is a good thing. I think we should welcome it, and feel a lot safer.

    Unfortunately, there is a disproportionate number of fraudsters among Yidden, from the secular Madoff to the Haredi-poseur Weinstein. Instead of Rabbonim giving countless drashos about chumros in kashrus, etc., they should be concentrating on mitzvos bein adam lechavero.

    it seems the anger towards Weinstein is that he stole from yiddien not the fact that he is a ganov. If the victims would be non Jews the comments would be much different I understand their is more anger when something happens to you, you, relative and so on

    that is very sad

    PS this is not unique most scams that people perpetrate are almost always against their own. Mainly for two reasons, access and trust

    It’s scary how a young guy can lower himself so much and commit these enormous crimes. And to steal from his own community! i wonder how it all started.
    I dont agree that there is something wrong with the justice system. Every responsible citizen knows the repercussions to these crimes. its a no brainer. You steal, you get punished. His family must be going through a lot but he deserves it, unfortunately.

    all the ppl that got screwed up r at least they see revenge….i have “frum” jews that have hurt me so much yet they are prospering and blossoming……bec. of that i dont want to b frum anymore….where is yashrus? and when will i see my enemies downful? please tell me where i can go fo support to stop being frum. im dead serious. im an ffb and 90% of frum ppl are horrible disgusting disgraceful ppl- to their own- not even on such large public proportions….even the ones dressed sooooo frum…ive seen them abuse and use ppl…..and steal…and teh Loshon Hara forget about it…mein tzaaros is dein gelechter…seriously- i have lost faith in most of humanity and the ones i know the best are frum jews so thank you all for turning me off…..im not a teenager….i stayed frum thru trials and struggglesbut i give up…im planning to b mechalel shabbos this week….its sad bec, i have a conscience and great yichus yet i feel i cant believe anymore,….any words of chizuk wld be greatly appreciated….not mussar please..or we dont know why things happen blah blah….i give so much tzeddaka that no one knows about….yet my merits dont seem to stand by me……sorry for venting ..

    These are disgruntled investors who lost money in the real estate bubble & their trying to get the US attorney to act as a collection agency. In Mr, Weinsteins good times, when he was selling portfolios of AAA properties & giving tremendous charity to the poor & destitute at all hours of the day & night, no one was saying any bad things, You were all at his doorstep with your hands open. Wheres your Hakoras Hatov ?

    Maybe he should use Levy Aron’s lawyers. They’ll claim he’s also hearing voices or he was an addict and compulsive gambler, and his actions were simply out of his control. I feel very bad for all the people he conned and for his family too. Hashem Yerachaim.

    Based on the calculation used to sentence Rubashkin to 27 years, he should be sentenced to about 200 years if convicted.

    Hey Guys!
    I don’t know if he’s guilty or not. One thing I do know.
    When these feds start saying things like, “and making charitable and religious contributions which he used to elevate his reputation within the Orthodox Jewish community”, when they have no way of knowing his motive for giving lots of tzedoko, that makes me kind of doubt that they have any real evidence against him.
    Maybe he really does have a soft spot for people in need and yeshivos.
    He lived in a simple house in Lakewood, nothing glamorous.
    These fed prosecutors are out of control.

    What is the difference between him and Rubashkin? Both are accused of fraud, one against banks one against individuals (unproven at this time).

    To all of those commentators who either denied that this individual is frum, or who stated that this story should not have been posted on this site in the first place, I’d like to add my humble opinion. First of all, people should stop acting like ostriches, and get their heads out of the sand. Of course, there are frum Jews who commit white collar crimes, as well as non-frum Jews (such as Madoff). There is good and bad in every ethnic community, whether Jew or gentile. Secondly, I’m glad that this story was posted on this site, as these matters (or other criminal activity), should not be swept under the rug. What is worse than these crimes being allegedly perpetrated, is that in many cases, there is virtually no remorse which is shown.

    The reason why Shabbos is called an “Ois” or Sign..is because it’s like a sign on a store. The store may be closed sometimes..even for weeks at a time but as long as the sign is still on there’s a store there. Once the sign is taken down then it’s over.
    That’s why he’s called “frum”
    If he would come out and say that I don’t think what I did was wrong and would do it all over again because I dont believe that there’s anything wrong with stealing then he’d lose his “frum” classifcation.

    Dude, what you do is your business. If you came on VINNEWS looking for sympathy, you came to the wrong place and need a lot more help than even you realize. You have bechirah chofhsi – use it how you wish. I’m not the one who came on here crying about how this yid did this to me and that yid did that to me. I’m smart enough to realize that people are people, and just because someone who lives a frum lifestyle commits a crime, that doesn’t reflect on the Torah itself – that just means people are people. My post was neither a dig nor a comment in support – if you want to do those things go ahead, that won’t make you less of a Jew. It will however make you less of a practicing Jew. And in my humble opinion if you are going to brand yourself, do it the right way. If you want to be “non frum” it has nothing to do with my comment – that’s your choice and your cheshbon, and you’ll have to answer after 120. Me? I’m fine with you either way, you’re still a member of the tribe – but that doesn’t mean I have to give you a shoulder to cry on. Nor do I have to or can I make the choice for you. Hopefully your understanding of the system is better than what a few bad apples do.
