    Washington – In an email send to all those who signed up to the Rubashkin petition calling for an Investigation into Allegations of Prosecutorial & Judicial Misconduct in the Case, The white house has replied saying they cant get involved. The petition had 52,226 signatures.

    Why We Can’t Comment

    Thank you for signing the petition “Call an Investigation into Allegations of Prosecutorial & Judicial Misconduct in the Case of Sholom Rubashkin.” We appreciate your participation in the We the People platform on WhiteHouse.gov.

    As explained in the We the People Terms of Participation, the White House may at times decline to comment on certain specific matters properly within the jurisdiction of federal departments or agencies, federal courts, or state and local governments in its response to a petition. For important policy reasons, this includes specific law enforcement and judicial ethics matters. With respect to law enforcement matters, the Department of Justice is charged with investigating crime and enforcing our laws. The Department also has mechanisms in place to investigate allegations of prosecutorial misconduct, including through its Office of Professional Responsibility. With respect to judicial ethics matters, the Judicial Conduct and Disability Act of 1980 vests primary responsibility for investigating and adjudicating claims of judicial misconduct with the Judicial Branch.

    This petition calls for an investigation into allegations of prosecutorial and judicial misconduct in the case of Sholom Rubashkin and for action to correct the “gross injustice” in his case. For the reasons given above, the White House declines to comment on matters raised by this petition.

    Yup. I just got that email. Kinda ridiculous since the point of the site is to bring up any grievance that we have that has not been addressed by other gov departments.

    I’m literally crying. I feel so bad for him and his poor family who nebech were the korbonas from the American justice system. Shame on the Obama administration. It just shows what we can expect from them.     Wow, I feel like such a nothing. Here we had a president that promised to hear your voice. Just get 5000 signatures on a petition. Then forget it – get 25000 – we can’t be bothered. Well they got 50,000. FIFTY THOUSAND!! And the answer we got? “We refuse to comment!” This isn’t WE THE PEOPLE – it’s a joke. It is a sham. You know what it says? This ain’t no difference than the sham elections they run in communist countries. We’ve all been lied to. We are a bunch of suckers. The president listens to no little guy. I never thought I would say this but I MISS BILL CLINTON!!!!

    lets get together and put up a demonstration against our justice dept. and Obama, for giving us these kind of answer after having klal yisroel coming out with such achdus in sucha short amount of time! Lets take petitions now how many pple will come out and demonstrate against our justice. this will give white house back their answer.

    1. Did anybody really expect “him” (It’s the entire administration, not just obama) to do anything?

    2. Did these morons even read the petition or are they deliberately avoiding the Issue? What do they answer? “The Department also has mechanisms in place to investigate allegations of prosecutorial misconduct…” That’s exactly the point of the petition, to have them stop ignoring the calls for an investigation!
    Nobody asked for y a “comment” we asked that you “direct your Attorney General … To initiate an investigation into this case” Thank you for telling me “The Department… has mechanisms in place…” That’s what we asked, that you put these mechanisms to use.

    I think the appeals process needs to run its course before the White House gets involved. All of the allegations of prosecutorial and judicial misconduct still have the opportunity to be heard by the U.S Supreme Court.

    I guess when the Supreme Court ruled on campaign finance law, then Obama had no issue to make disrespectful remarks in the State Of the Union speech while the supreme Court justices present. what a joke.

    Isn’t the department of justice under Obama’s charge?! Yes it is! Then why doesn’t the white house refer the petition to the people in charge of investigating judicial misconduct?! Why just brush aside 52,000 signatures?!

    And if the Obama admin won’t do it, why can’t we take this petition straight to the justice department?

    Cutting through all the legal double talk, this response is simply that the White House calculated that it isn’t worth it to get involved. When it comes to the power of the White House to intercede, there’s no such thing as “We really wish we could, but just can’t.” There’s only one consideration: “Is it worth enough politically to care.” Clearly, in this case, the Obama White House doesn’t think so.

    This response was expected by most ppl that understand how the system works, and it was still pursued mostly to raise awareness to the case, bringing it to the attention of ppl that otherwise would not have heard or known about it, and showing that a lot of ppl believe that there was a injustice done, and took there time to sign the petition, raising awareness to a case will definitely help in the long run if the appeals don’t work (c’v)

    Does anyone know the Department of Justice’s policy on petitions? Can’t we send it there? 50,000 signatures should not go to waist just because the white house refused to comment!

    Gee, I hate to say I told you so, but…I believe the response I predicted is almost verbatim what the actual response was. Mine actually had a bit more sympathy. Wow, it’s too bad because all the White House has to do is ignore the separation of powers as stated in the Constitution and then Obama could call a car service for SMR personally.

    1) was anyone here really going to vote for him even if he did pardon rubashkin? NO
    2) He never said if you get the votes we will listen to you, it says they would address the issue. The issue was addressed, and you got a we can’t do anything about it. The same thing was basically said to those asking for loan forgiveness, and medical marijuana.
    Why is it that when it comes to tefillah and the all mighty we recognize that G-D always answers, its just sometimes a no, and yet when it comes to a man (someone with infinitely less power than G-D), we get upset because he says no?

    I am nor a lawyer who can go through the “Terms of participation”, but i think this response given from the white house is based of the following paragraph in the terms of participation page; “To avoid the appearance of improper influence, the White House may decline to address certain procurement, law enforcement, adjudicatory, or similar matters properly within the jurisdiction of federal departments or agencies, federal courts, or state and local government in its response to a petition”.
    I would like to know which issue is NOT in the jurisdiction of other agency’s other then the white house.
    We should let the White House know that the USA is not China where the Government speaks, and the country believe. This response was 100% beating around the bush.

    These people need to be held accountable to the untold hours of lost torah all because they didn’t think it important enough to understand the metes and bounds of the powers granted through the petition.

    What a waste of time.

    And to all those people who slept through civics … unless you were asking for a presidential pardon why would you think that a petition to the president over-rides the constitutionally mandated separation of powers…

    Hi,

    As a citizen in this great country I would like to express my big disappointment, although I know my email will never get anywhere trough all the big government red tape in this administration, writing it will at least get it off my mind and I’ll know I did the most I could.

    You write in your responds to the over 50,000 petition that we should review the terms and conditions and the white house doesn’t have to get involved in certain forms, basically a way out and saying for over 50,000 the WE THE WHITE HOUSE can hide under some terms and not even look into your issue raised, isn’t this the reason why the white house created the we the people? Is the only reason for creating the we the people a political move? And in reality its a smoke? Is this a auto reply after several days? Is this another way of showing to average working american that are not in the white house, Screw you! We own you! We will make fun of you and use you on every way that benefits our political ways.?
    All we (the over 50,000 people) wanted was for the white house to look into his case and see if he was treated right, why come back with a non sense answer.?
    Remember screwing over the people by showing them they are a joke will come back to bite you…

    I see a positive in the WH response. Though it is unintentional. The WH broadcast that they can’t interfere when there are already systems in place. Well, isn’t there systems in place for “everything” in the Legal system and yet they have chosen to create a “back door” by allowing Petitions? Indeed. It’s a sham. And now that sham is exposed before it could do any real damage. No “special privileges” for any crooks behind bars. So if the WH tries to let anything slip out, the Courts will hear from everyone citing this ruling and tell the WH not try & beat the legal system.
    The bad news is, SMR better not be the next Pollard. The WH has always maintained the Pollard presented a serious problem by showing Yidden that they can spy for Israel so they are making a Korban of him.

    Even though I signed the petition the outcome was pretty obvious. The point of the site is to bring up a grievance involving the government. This does not involve the government; it involves the judiciary which through he doctrine of the separation of powers is completely separate from the Government headed by the President.

    Dear White House:

    We appreciate the prompt response.

    However, we didn’t ask for your ‘comment’, we are calling for an investigation.

    The DOJ indeed has ‘mechanisms in place’ to investigate prosecutorial misconduct. However, over 52,000 people seem to find that the mechanisms seem to be deficient in regard to this case. All inquiries to Mr. Holder to explain the harsh sentence in this case have been thus far ignored (not even so much as a ‘comment’.)

    We are asking that the White House investigate the failure on the part of the Department of Justice to adequately respond to requests by numerous legal experts, former Attorneys General, members of Congress, as well as thousands of fellow citizens.

    We look forward to presidential intervention in this matter so our faith in the US Justice system can be restored.

    This petition should not only be viewed as an abject failure in the sense that it didn’t get 5 minutes knocked off of SMRs sentence, or even an extra pudding for desert on Tuesdays, but more importantly, as a fools errand for the 52k signers who have no clue when it comes to American jurisprudence.

    Avoiding a desicion is often the preffered option in a contraversy. However, the opportunity presented by the White House through the We The People tool was to give the people a voice to the White House in a manner that surpasses the comments desk option. Implied though is a popular perception that when enough voices are amassed on an issue the White House i.e. the Country’s supreme authority the Persident would take notice and take action.
    The White House’s choice to hide behind seperation of powers doctrine in the Rubashkin matter is remarkable. Suggesting those concerned go to Attorney General Holder for an investigation concerning Rubashkin belies either disdain or contempt towards the Jewish community. AG Holder if I am not mistaken has already turned down requests for an investigation. Suggesting to return to the Department of Justice is incredible. The Civil Rights issues raised on Rubshkins appeal were joined in Amicus brief by among others the ACLU. The White House’s reponse is akin to telling an employee mistreated by a supervisor to back to that supervisor to file the complaint . This is sooo wrong

    As another comment suggested earlier, the silver lining in this refusal is apparent, and there may be more than one such lining. For one, the President has demonstrated that his petition process, which was intended to convince the population that he is a “people’s president” is nothing more than fluff. This refusal portrayed that well. He just passed the responsibility off claiming that this was not the job of the administration. He also proved to American Jews that he will not take us seriously. After all, one can get elected to national office without the Jewish vote, except, perhaps, in a district that is chiefly Jewish (Turner). That thumbing of the nose is a strong message, and one may expect enough of the Jewish population to hear it and remember it in 2012.
