    Brooklyn, NY – A man stabbed on a subway platform during a spat with two men said he had the upper hand until the toughs pulled out a blade.

    Emil Benjamin, 30, was on a southbound F train approaching a station at Fourth Ave. and Ninth St. in Park Slope when the two men started cursing him out with anti-Semitic slurs about 9:40 p.m. Monday, he said.

    “They said, ‘You’re nobody, you Jewish bastard,’ ” Benjamin said.

    Benjamin, a Kavkazi Jew, and a loan broker from Bensonhurst, punched one of the brutes in the mouth, busting his lip open. But as the duo ran away, Benjamin felt something pouring down his back.

    “I felt blood gushing out of my back and my left leg,” he said. “It was sizzling hot, like a hot shower. My blue jeans were red. My sneakers were soaked with blood.”

    As bystanders called for help, Benjamin, who was stabbed in the back and left thigh, spotted a blood-soaked knife on the concrete platform. He was rushed to Lutheran Medical Center, and cops busted the suspects nearby.

    Rafael Padin, 22, and Jose Santos, 18, were charged with assault. Padin, who sliced his own hand during the stabbing, was also slapped with criminal possession of a weapon.

    Police said they are not investigating the incident as a hate crime.

    “If it was just fists, I might have been able to fight them off,” Benjamin said. “But I couldn’t handle all the blood. ”

    Still, Benjamin said, no one should ever resort to violence. “The best thing to do is walk away with a smile,” he said. “Smile to life, and life will smile to you.”

    Why isn’t the NYPD investigating the incident as a hate crime?

    Why isn’t this a hate crime? They verbally assaulted him before the altercation because he was a Jew and then stabbed him! They may have stabbed him even if he hadn’t punched the guy. If someone of a different ethnic or racial group had been attacked this way would it have been a hate crime? Of course! Is the NYPD afraid to acknowledge the uptick in anti-semetic attacks?

    It is the District Attorney’s Office that makes the ultimate decision about what charges are brought, not the police. Mr. Hynes has a mixed record on these sorts of crimes.

    The police are not charging this as a hate crime because they know all the facts newspaper articles don’t. If there is a fight and someone screams a epithet its a totally different matter.

    The best thing to do if provoked, WALK AWAY!!

    It’s barely been 12 hours. The police need to review video surveillance, get statements, etc. This isn’t television, it may take a while.

    To #10 - I agree. If the Jew attacked those two Hispanics, he would be in a heap of trouble. However, when it is the other way around, it appears to be acceptable! A Shanda! This reminds me in 1984, when Bernhard Goetz was riding the subway, and minding his own business, when he was accosted by several minority punks. He shot and wounded several of them. However, the newspapers made him into a “racist vigilante”. However, if Goetz had been beaten or worse, the newspaper columnists would have cared less. P.S. The two Attorneys who filed suit against Goetz on behalf of the “victims” were two Yidden, Kunstler and Kuby!

    Why hasn’t there been any arrests in the Ocean Parkway Car Bombings. Perhaps the FBI should get involved and solve the case.
