    New York – Brooklyn DA Charles “Joe” Hynes is under fire for his handling of child sexual-abuse cases in the borough’s ultra-Orthodox community — with critics suggesting a double standard in how such crimes are prosecuted.
    Former Mayor Ed Koch has even suggested that Gov. Cuomo supersede Hynes and appoint a special prosecutor to handle such cases.

    It’s an idea worth considering.

    The Post and other news outlets — notably the Jewish Week, the Forward, several online blogs and, lately, The New York Times — have been reporting on this subject for years.

    Perhaps most egregiously, Hynes refuses to make public the names of those formally charged with sexually abusing youngsters in the ultra-Orthodox community — even after they’ve been convicted.

    He says that’s to protect the victims, who could easily be identified in the close-knit, insular community. But that’s a policy neither he nor any other prosecutor allows for any other group.

    Experts say it has the opposite effect — reinforcing a culture of secrecy that sweeps such allegations under the rug.
    He has also never publicly opposed a widely held policy in the ultra-Orthodox community requiring suspicions of child sexual abuse to be submitted to a rabbi, who decides whether to notify police.

    Community groups stress that this doesn’t apply to clear-cut evidence of abuse — only to those cases where the evidence is not undeniably conclusive.

    Problem is, that’s the overwhelming majority of child sex-abuse cases — and there are laws mandating that law enforcement be notified, without any pre-screening.

    Which is why Hynes in 2002 signed a memo of understanding with then-Bishop Thomas Daily, mandating that the Catholic Church report all abuse allegations.

    There have also been cases when convicted ultra-Orthodox child molesters have received extremely lenient sentences, several involving no jail time.

    Hynes says that in many cases this is because the victims’ parents don’t want their children to testify. But some of those same parents have told reporters they felt pressured by the DA’s office into approving a plea bargain.

    Then there’s the matter of widespread witness intimidation — socially ostracizing pressure from within the community on victims’ families not to prosecute, especially when those accused are prominent rabbis or lay leaders.

    Sad to say, the community itself too often seems more inclined to protect abusers, rather than their victims.

    Just last week, in fact, more than 1,000 ultra-Orthodox Jews gathered at a sold-out event to raise money for a therapist accused of molesting a girl during four years of counseling, starting when she was 12.

    As The Post’s Sue Edelman reports today, Hynes has accepted Koch’s suggestion to form a committee of law-enforcement experts to figure out how to handle the problem of witness intimidation.

    Alas, that’s far too little, far too late.

    Indeed, as Koch suggested in an e-mail exchange with Hynes, “bringing a single, successful [witness-intimidation] case with a prison term will end the problem.”

    Maybe, maybe not. But it’d sure send a message.

    A quarter-century ago, another Gov. Cuomo named Joe Hynes a special prosecutor after complaints that the then-Queens DA was refusing to aggressively investigate the racially charged Howard Beach case.

    That move allayed any suspicions of preferential or lenient treatment and ensured the full prosecution of all those involved.

    It may be time for history to repeat itself. Joe Hynes should understand that better than most.

    Boruch Hashem a step in the right direction. I a 47 year old still remember the abuse of my 3rd grade rebbe. And when I reported it to the principle my pants came down and I got it with sa belt for false accusation. May hashem avenge for this cruelity which left me with doubts about yiddishkeit

    I’m dumbstruck!

    since when is it a crime to help someone you are convinced is innocent prove his innocence! I’m referring only to the fundraising saga! all the people I spoke to claim to know this man and that the claims are outrageously rediculous! can’t they just help a fellow jew they believe being wrongly accused!

    our problem is that this bucher is soo full of hate, and he has found a venue to spit his venom to get “even” with the orthodox community, with a nice coverup! I know innocent until proven guilty shouldn’t apply to accused sexual molesters, cause this wacko wants to get even with the jewish community! (and that does include even the innocent orthodox jews who he’s slandering!)

    This is hashem’s way of filtering out the shmutz of sexual molestation.

    Yes, there are cases where Rabbonim have tried to curb this, but it seems that as long as it is not exposed head on and in bright sunlight it will never go away.

    Thank you for Hashem’s mercy of his innocent children. May his wrath come down on those who take away a child’s innocence and their protectors be exposed with the shame they deserve.

    No need for names!! If an abuser is accused, he should be tried by his peers by 12 men and women according to our justice system in a Court of Law!! You are here in the USA and are bound by its laws to obey them and follow them. Not just the laws that you ‘feel’ like following!! If you break a law, you get arrested just like everybody else, (if you get caught) !! No privileged characters!! Now you need privileges for child abusers!! What about the abused child!! Who is going to protect them? Can we trust our Yeshivas any more? Have all the Rebbes been finger printed? If not, then we send our kids to Yeshivah and pray that nothing happens to them!! Only Hashem knows!!

    So much attention is being paid to child molestation in chasidic communities as if it is of epidemic proportion which is clearly not the case!

    Its very painful that our least problem has become our biggest enemy!

    Now every Chasidic jew with beard and payos will be viewed in the world as a child molester just like the stereo type the Priests have made of themselves.

    guys take a close look at the Europe system how different it is from the U S, any one who been accused of any crime is not allowed to be published when arrested if possible to keep it low , because you are innocent till proven guilty after a trial only and not before, we here acting like doges united on one bone, why?

    Hynes has it all wrong. Once the Rabbonim and Askonim know that they TOO will be locked up and have THEIR names released to the press if they dare try to harass the victims into not testifying it will stop. Once victims come forward they should be put under 24 hour NYPD protection and their phones tapped. Any yeshiva or shul or Rabbi threatening to throw the victims out should be sued and punished. The high level Yiddishe staff in the DA’s office should start looking for new jobs.
