The U.S. Court of Appeals for the D.C. Circuit says Obama did not have the power to make recess appointments last year to the National Labor Relations Board.

Obama claims he acted properly because the Senate was away for the holidays. But the court says the Senate technically stayed in session when lawmakers gaveled in and out every few days for so-called “pro forma” sessions.

GOP lawmakers used the tactic specifically to prevent Obama from using his recess power to fill vacancies in an agency they claimed was too pro-union.

The Obama administration is expected to appeal the decision to the Supreme Court.

Can’t say that I am shocked. His abuse of power is appalling.

Can’t wait for the Obama apologists to state “all Presidents abuse their power”

This is the best news this country has had since this mad tyrant has begun his reign of terror.
It’s going to go to the supreme court, and we’ll see if Roberts can break out of his medicated and blackmailed state that caused him to shrug at liberty and allow obamacare to destroy our healthcare system.

The comments of the first two posters would almost be amusing if it were not for their approval of unprecedented Republican obstructionist tactics that are very damaging to this country. Because the Republican Congress is refusing to approve an appallingly large number of appointments, which has never been done in our history, there are large numbers of vacancies in our judiciary. This means our judges are overworked and likely to make mistakes. Our administrative agencies often have no leaders because the Republicans will allow no one to take the position. The Republicans are not obstructing based on the qualifications or positions of the candidates – they are just refusing to allow just about anyone. If you criticize Obama for trying to get this country functioning but do not recognize the harm your party is doing to democracy, then the only conclusion is that you are still annoyed that Obama is black. Deal with it.

what is hilarious is the fact that the President taught constitutional law and the appeals court probably hs some Bush minions on its bench.
