    The NEW YORK DAILY NEWS (http://nydn.us/193G4Qt) reports that prosecutors argued that 37 year-old David Flores—who has a lengthy arrest record, which includes charges of public lewdness and weapons charges—was carrying a “loaded” firearm and was “intent” on not being arrested again for public lewdness.

    Members of the Shomrim volunteer watch-group confronted Flores after receiving a call from a Borough Park mother that Flores had committed public lewdness in front of her child in a parked rental car.

    Police and neighborhood leaders had received two calls the previous week of a man fitting Flores’ description performing the same publicly lewd act.

    Flores, who is charged with four counts of attempted murder, along with weapons charges and public lewdness, faces up to 100 years in prison if convicted.

    If he were licensed to carry a firearm, he could possibly make that claim, but a felon can’t get a permit anyway.
