New York – Wall Street Journal: Dov Hikind Will Start To Reveal Names Of Molesters To DA Hynes

    New York – It began on the radio this summer. New York Assemblyman Dov Hikind ran a segment on his Saturday night talk show titled “We Are Only as Sick as Our Secrets: Sexual Abuse, Healing the Shame,” featuring graphic accounts of sexual abuse of children in the ultra-Orthodox Jewish community in Brooklyn.

    There had been a few high-profile cases before, but this “was when the floodgates opened,” explained Mr. Hikind, an Orthodox Jew himself. Following the show, additional victims and their family members came forward to share with Mr. Hikind their own stories. “Cases of sexual abuse are not worse among the Orthodox,” clarifies Mr. Hikind. “But when there’s a problem and you don’t deal with it, it gets worse.” Over the past few months he has collected hundreds of testimonies spanning several decades, naming at least 50 alleged pedophiles across the tri-state Orthodox Jewish community, including well-respected rabbis and teachers.

    But now these testimonies have become a source of contention. They have been subpoenaed for a civil suit by a lawyer representing six former students of Rabbi Yehuda Kolko, a longtime teacher at one of Borough Park’s leading all-male yeshivas, who has been charged repeatedly since the 1980s with sexually molesting his students. (Last year Rabbi Kolko pleaded guilty to child endangerment.) The problem is that Mr. Hikind had sworn to keep the testimonies confidential.

    Mr. Hikind claims he will “do the right thing” about the subpoena without betraying the names of any of the victims. While he will not hand over his complete list of alleged perpetrators, he says that “we are starting to share names” with Brooklyn District Attorney Charles J. Hynes.

    Many people give Mr. Hikind credit for bringing much needed attention to an issue in the Orthodox community that has frequently been swept under the rug. (One exception to the silent treatment was the Orthodox Union’s creation of a special commission in 2000 to investigate the sexual abuse charges against Rabbi Baruch Lanner, leader of the National Conference of Synagogue Youth, who was later convicted.) He also deserves credit for getting victims to talk at all. Mr. Hikind says that he encourages each victim who comes to him to go directly to the police, but no one is willing to. They are too afraid of the repercussions for themselves and their families in terms of reputation and marriageability.

    The trouble is that subpoena or no subpoena, he has valuable information that is not being effectively utilized to investigate the alleged offenders and get them off the streets. “Dov Hikind has decided that secrecy is a more worthwhile value than child protection,” explains Marci A. Hamilton, a professor at the Cardozo School of Law and an expert in clergy law. By witholding the names of the perpetrators, “he is sharing in the responsibility of every child who is harmed by them.”

    What Mr. Hikind wants to do instead is tackle the issue from within the community. He has assembled a task force of rabbis, therapists, principals and pediatricians to help the community respond to cases of sexually abused children — raising awareness, forming a registry of teachers (so that a teacher who is removed from one school does not simply go to another) and devising a system of investigating allegations. Investigation is extremely important, he adds, because “you have to make sure an innocent person is not being thrown to the wolves.”

    While Mr. Hikind’s effort is well-intentioned, Prof. Hamilton calls it “a doomed project.” Resolving cases of sexual abuse without the legal establishment in this country “has never worked in any other religious community,” she points out, citing the Catholic Church as an example. And the truth is, many rabbis agree with her. According to Rabbi Mark Dratch, the chief executive officer of JSAFE (The Jewish Institute Supporting an Abuse-Free Environment), “Rabbinic authorities do not have the expertise or ability to handle these things. Making reports [to the legal authorities] is the only way to go.”

    Mr. Hikind insists that his plan does not look to circumvent law enforcement, but to collaborate with it. The question, though, is if the ultra-Orthodox constituency that Mr. Hikind is working with will be a real partner in this endeavor. In the past, they have unfortunately been resistant, worrying more about the consequences of disparaging renowned Torah scholars than about protecting a child’s life. Some rabbis in the community have even impeded the efforts of other rabbis who are willing to speak out and take action. Orthodox rabbi and psychologist Benzion Twerski resigned from Mr. Hikind’s task force for fear of tarnishing his reputation and his family’s reputation within the community. In Williamsburg, Rabbi Nuchum Rosenberg received threats for speaking out against abuse in his community.

    So is Mr. Hikind’s plan “doomed”? It depends. If the community is willing to take more cases to the police rather than watching alleged perpetrators float from one community to another, where they will no doubt prey again, then great. But if they are not, if they succumb to the same social pressures that have paralyzed them for decades, then every day that goes by another community of children is at risk.

    No matter what happens, though, Mr. Hikind promises not to reveal any victims’ names. “I will not, God forbid, destroy a person’s life all over again,” he says. That’s good. But let’s hope another child’s life is not destroyed either.

    Everybody agrees that a molester do have a din RODAF like a someone who want to kill you child and we must give he him over to the legal experts so everybody have to tank him.

    can it be that 50 out of a million is a big overstatement and that giving names to hynes is a mistake because he will attack the jewish community with them like getting the press involved

    I know the problem in the community: they don’t know that a molester is damaging the child, it’s in their eyes like a tzenuos issue the rabbis are innocent because they are not so educated. We have to bring in some professors to explain the big picture.

    I think Dov Hikind is doing a real disservice by mot mentioning names, once they are proven theyare the perpetrator. Why hide these animals? “he doesnt want to ruin anyones reputaion” but what about ruining these children? oh well, they will have 8 more, whats one messed up kid?

    The issue is that if he says that the alleged perpetrators will be reported, no one will come forward to him since they would fear the backlash of having reported the perpetrator (consider the small world nature of the frum community and the impact of these things on shidduchim, etc.). Doing this quietly and trying to get more people help instead of getting a limited number of people to be publicly charged may have a greater impact on the whole and that might be the rationale for this. That said, from a legal perspective, there may have been some privilege if the victims went to an ordained rabbi for counseling, but I don’t know.

    This should have been done ages ago. Better late than never I guess. The Jewish community as a whole has to stop shoving this issue under the carpet and make it known. Otherwise our children are doomed.

    Dov Hikind tried his best to not be labelled a ‘moser’ – he thought that a Charedi Bais Din might step up to the plate – instead the Charedi Rabbis stuck their heads in the sand – thus it goes to the DA and also the public via the press.
    Smooth move Rabbis you have allowed this to make a huge chillul.

    why doesnt someone just rig up the kids who are currently being molested or the rooms/cars/whatever where it’s occurring with a wireless mic [and camera] and have it recorded….that is a serious bargaining chip. nobody can deny that…..

    Doctors, psychologists, mental health professionals, etc are all mandated reporters–that is, by law, they are REQUIRED to notify the authorities when there is a reasonable chance of a child having been abused or neglected.

    This law should be extended to include rabbis and rebbeim in our schools.

    It is clearcut that the ONLY way to help prevent further molestation is by getting the police and courts involved. The people who perpetrate these sexual crimes are like drug addicts. They cannot stop themselves. They are rodfim in the most classic sense of the word.

    Our leaders who do not lead and instead cover up for such despicable rodfim are not really leaders at all.

    Kudos to VIN for continuing to publicize this issue. The mainstream haredi media hides these unpleasant facts.

    everyone is right about molesters its a tragedy but what if he has his own family?his own kids? who will now suffer as well for no good reason. let’s use seichal in how to deal with this not emotions. some of these pepole with proper handling have turned around to lead a normal life without further victems and with minimal chilul hashem.

    The point here is that Assemblyman Dov Hikind is a practical person who is taking a realistic approach to the [very] painful problem (on all levels). While the [esteemed] Professor from Cardozo law School (which is a problematic entity unto itself, to those of us who remember the controversies surrounding it in the ’80s.) lets loose all of her prejudices, she also doesn’t have a practical solution to suggest, like some Professors who “Talk without their Brain being Engaged”!!!

    YASHER KOACH !!! I can not thank you Dov Hikind enough for finally taking these “MONSTERS” to task. Enough is enough. I once heard a comment from a good friend of mine. As long as people drink “chalav yisroel” and eat “Pas Yisroel” they are considered HEILGEH and CHOSHUVA mentchen. (CHALILAH V’CHAS if someone eats “pas akum” or “chalav stam it’s almost tantamount ( the same as) to eating tarfus.) So what I’m trying to say is it’s rare to find “chalav stam” in Boro Park, because “CHALAV YISROEL is so much more important than keeping these monsters off the street. OY VAH VOY what are we going to say to the Ribono shel olam after 120 years? We saved all the molesters from shame but don’t worry we never ate a Hershey bar. Keep up the good work! I know it’s not going to be easy, but if you are doing this l’shaim shomayim all you have to know is “HASHEM HOO HAELOKIM EIN OD MILVADO” Hatzlocho rabba.

    “Sharing names” means absolutely nothing. The only way to even investigate a perpertrator is to have the victim testify to the authorities. In the case of a Rebbi who is employed at a Yeshiva , that victim will need to testify to the EMPLOYER. If the employer and Board cover it up , the victim will have to bring his/her testimony to the legal authorities.
