Amran, Yemen – Court: Jew Killer Mentally Incompetent Only Needs to Pay Blood Money

    The slaying of Jewish teacher, father-of-nine, Moshe Yaish Nahari last December in Omran, north of the capital, San’a, raised fears of anti-Semitic attacks across the country.

    Today’s ruling says the defendant – Abdel Aziz Yehia Hamoud al-Abdi, a retired pilot in the Yemeni air force – is “mentally unstable.” It orders he pay $27,500 dollars in blood money, sparing the man from a death sentence as he was “mentally abnormal.”

    Abdul Aziz Yahya al-Abdi, 39, remains in detention after admitting in December to the shooting in the town of Raydah in Amran province.

    Nahari’s widow and father said they will appeal the sentence and call for the death penalty.

    Abdi, had repeatedly said he carried out the murder after warning Yemeni Jews that he would kill them unless they converted to Islam, the court heard during his trial last month.

    The prosecution had called for a death sentence to be imposed but the court opted for the blood money sentence after medical reports showed Abdi was “mentally abnormal”.

    As the court session got underway today, the authorities sealed off the court building for fear of a violent backlash in the village north of the capital Sanaa.

    When the verdict was read out, the dozen people present inside the small courtroom expressed relief, except for the victim’s widow and father.

    Police hurried to empty the courtroom as soon as the trial was adjourned and prevented journalists from speaking to people present.

    The convicted man was calm throughout the session, reiterating earlier remarks that he “has given the Jews the choice of converting to Islam, leaving Yemen or being killed.”

    Abdi killed his wife five years ago but was spared prison when he was ruled to be of unsound mind.

    Nahari’s father said earlier that Abdi accosted his son, with whom he was not acquainted, near the victim’s home and insisted that he convert to Islam.
    Nahari, who taught Hebrew in one of Raydah’s two Jewish schools, asked to be left alone but Abdi then opened fire with a submachine gun until he was riddled with bullets, the bereaved father said.

    Lawyer Khaled al-Anisi representing the slain teacher says the court showed “prejudice” and warned the light ruling opened doors to attacks that could lead to the eviction of the Jewish community from Yemen.

    Amran is home to some 250 of Yemen’s remaining Jewish minority of about 400 people.

    In 1948, the country’s Jewish community numbered some 60,000. But in the three years following the creation of the Jewish state that year, more than 48,000 emigrated to Israel.
    The community continued to dwindle in subsequent decades and by the early 1990s it numbered only around 1,000 people.
    The lifting of a longstanding travel ban in 1993 sparked a fresh exodus.

    Ten Yemeni Jews moved to Israel last month after Nahari’s murder and a series of other attacks that triggered fear among the Jewish community.
    Among the new immigrants who landed at Ben Gurion international airport was Said Ben Yisrael, who heads the Jewish community in Raydah.

    i didnt expect anything else. we are in gules. eisav soneh l’yakov, thats a given, but if we continue to behave like idiots in america then this verdict will come to a court near you

    Wait until the guy hurts or murders someone in the judge’s family. Maybe then we will see real justice!

    And the family, who supported his murder openly in court, are also mentally incompetent? Crazy people kill themselves; normal
    (but bad) people kill others!

    The verdict is as expected; I had written here that the judge will give him a slap on the wrist; I was wrong, not even that. This mental defense is a crock; did the court find him mentally incompetent or did a doctor who he hired find him as such?

    It is unbelievable that in 5769/2009 a person can kill a Jew and has as his defense that hey I only killed a Jew and not even get admonished by a judge. We are back to the dark ages with all that it encumbers; fasten your seat belts, we are in for a barbarian ride.

    Obviously the animal has a mental imbalance since he murdered his wife. As a muslim he could have simply divorced her with a quick remark. The fact that this man was reported to be an airforce pilot is the scary part. The Yemeni Government must make sure he doesn’t have access to a plane. I am so saddened for the Rav’s mishpucha. The almanah is in terrible pain and I hope she will eventually find comfort, IYH. I am mispalel for the safety of the Yidden left in Yemen. Perhaps it is time for the holy remnents to make aliya to Eretz Hakodesh.
