    Beis Hamadrash Elyon orderd closeLondon – A Jewish school set up in a residential home in Golders Green has been ordered to close by a High Court judge.

    An injunction against the Beis Hamadrash Elyon school was granted after it opened without planning permission and defied orders to close.

    The school, on Golders Green Road, has until December 31 this year to cease operating.

    It opened in 2002 and retrospective planning permission was denied by a Barnet Council planning subcommittee in 2003.

    The Planning Inspectorate have previously upheld the council’s decisions.

    The council took the case to the High Court after receiving a number of complaints relating to noise and other problems from neighbours, (as was reported here on VIN News).

    At least the British courts have the backbone to enforce their builing use and zoning laws. By opening without the proper administrative authorization under the London codes and then seeking a retroactive non-conforming use permit, they made a mockery of the procedural requirements and deserve to be shut down. Jews should show the highest respect for the local laws and it seems that whether in Monsey or Golders Green, these ehrleche yiddin believe the rules only apply to goyim.

    good for the council. jews should follow the same rules as everyone else. there is nothing in the torah that says we are above the law.

    They converted to commercial use without a variance.
    They did extensive work without getting permits much less passing the required inspections.
    They’re misusing a single-family dwelling as a (substandard) apartment building and school.
    They’re endangering everyone there by not being in compliance with fire and safety codes.

    To hell with ’em.

    we dont know the reason why they didnt get plaanimg permission, its not up to us to judge.

    this is not true, there is no judgement from the judge at all.

    the building originally had planning permission for use as a kindergarten, it is in the middle of a row of houses that are shuls and offices, the next block in the street is a huge new building offices and residential.

    the building complies with all relevant fire and safety codes.

    to A. Nuran: maybe you get some anger therapy? it would do you a lot of good.

    Nothing smells except the conduct of those running this unlawful operation. Giving the school until the end of December was an act of mercy to give the parents time to find other schools for their sons. Since they have been sending them to a school being run illegally for two years and more that is generous. The parents may indeed find that they have to send their sons to secular schools and I have very little sympathy for them.
