The process varies by borough. Generally, drivers may refuse a breath test at the scene. They are offered the test again at a precinct, but can refuse. A warrant is then issued and blood is drawn for a blood alcohol test.
Critics say the lag gives drunken drivers time to sober up.
Police Commissioner Raymond Kelly convened a panel today after two off-duty officers refused breath tests in separate drunken driving cases where a pedestrian was killed. Both officers were tested hours later by hospital officials who drew blood.
In one case, the test showed no alcohol. The other test is still pending. Both officers were charged with manslaughter.
I would defiantly suspect that because they were officer’s, the cop’s that were in charge of their arrest made sure that the test’s weren’t given b/4 a few hours to give them time to sober up! Rest assured hadn’t they been involved in an accident, but ratter stopped for reckless driving or at a check point they would of been left to go free!
There may be two sets of rules, but there is only One G-d. What goes around comes around.
