Gerald Garson, 77, walked out of a Harlem halfway house a free man Wednesday after serving six months less than his minimum sentence.

Garson – convicted of taking a $1,000 cash bribe and a $275 box of cigars to settle custody in a divorce case – was sprung early because of good behavior and completion of a substance abuse program.

“It’s always nice to be with your family,” Garson said before climbing into the backside of a shiny service Town Car outside the Lincoln Correctional Facility on 110Th. St. in Harlem. “I wish you a happy holiday,” he told reporters before the car – with his wife inside – drove off.

Garson was transferred to the Harlem facility for a work-release program last month.

He did most of his time in a state prison in Orange County.

Garson was sentenced to 3-to-10 years after his 2007 conviction.

The Parole Board, in an unusual move, approved his early release.

If the board had rejected Garson, the judge faced a two-year wait for another review.

Among those there to greet Garson was Howard Moskowitz, 51, who encountered Garson during a post-divorce parental rights case involving his then 7-year-old son.

Howard Moskowitz greeted Garson with signs that said “Crime Pays” and “Justice for sale in NYC.”
Moskowitz claims he was wronged by the former jurist during a post-divorce battle with his wife over parental and custodial issues.

Carrying signs that said “Crime Pays” and “Justice for sale in NYC.” Moskowitz arrived at 7 p.m. to protest the early release.

“He’ll get what’s coming to him,” Moskowitz said. “It’s a sad day for a lot of litigants because he should have served the maximum for what he did. He betrayed his oath. He destroyed a lot of families. It’s another black eye for all of us.”

“The Parole Board, in an unusual move, approved his early release.”???
Unusual? Not at all. On a non violent 1st offense; the parole board always grants parole.

Up until recently, the court system in Brooklyn was as crooked as a three dollar bill. Since Clarence Norman went to jail, its gotten a bit better but there’s still a long way to go.

That being saig, Garson probably served an appropriate term in jail given the small amount of money he took and his age.

It sounds like this guy Moskowitz has some broigas with the judge because he lost his case. The early release was consistent with the normal practice in these types of cases.

Amazing how they are making the legal system more sea-through for us – then they wonder why we don’t believe that justice will be served. This entire system is corrupt!
