Oklahoma City, OK – An Oklahoma Muslim has filed a federal lawsuit against a state ballot measure that prohibits state courts from considering international law or Islamic law when deciding cases.

    Muneer Awad, head of the Council on American-Islamic Relations in Oklahoma, filed the lawsuit Thursday, saying it is unconstitutional. The ballot question was approved in Tuesday’s election with 70 percent of the vote.

    The lawsuit seeks a temporary retraining order to block the results of the election from being certified on Nov. 9.

    Joseph Thai, of the University of Oklahoma College of Law, says there is no danger of international or Islamic law taking over the state’s court system and the ballot measure is “an answer in search of a problem.”

    Wow this is scary! If I understood the article correctly the Muslims are brazen (chutzpadik) enough to try to get America to use international or Islamic law when deciding cases? Let them go to Islamic country to try their cases this is not Europe nor is it Jordon or Syria or Libya! Hash-m should help us that this never happens here!!

    This is how they want to start sharia law in the U.S. of A. first legally and then by force. DON’T OPEN THE DOOR FOR THEM!!!! for once they have there foot in we wont be able to close it.

    The new law is 100% correct.

    Sharia Law or any other religion’s laws should have no bearing on our U.S. Laws.

    We have freedom of religion in the U.S. Every religious group is responsible for their own laws within the parameters of U.S. Law.

    Sharia law is a Muslim religious matter.

    Kashrus is a Jewish religious matter but the state laws in force have been written to establish its enforcement as “consumer” laws rather than religious issue laws.

    According to US law, Judges must ONLY follow United States Law when judging cases. This also happens to be common sense; that a country should only rule based on its own laws. If we wanted Saudi Arabia law, we would move there. Of course, you never know with the 9th Circus of Shlmeils.

    What about U.S. Law in countries that are Muslim and have Sha’aria law? Would they for one tiny second consider other Laws besides Sha’aria? They treat their own people abominally in the name of Sha’aria Law. He’d never, ever, get away with such a lawsuit in a Muslim country…he wouldn’t even dare to try to bring a lawsuit out of fear to what might happen to him if he did. Only in America can he attempt to try such an insanity!!!!

    as soon as the Arab world can start taking international laws into consideration, i guess we can start thinking to reciprocate
    these guys don’t seem to undestand that under Sharia law, they would not have the right to voice their opinions!
    they live off the benefits of freedom of speech in order to destroy us!

    This is very bad for us. It sets the precedent that halachah can not be considered, either. Ultimately this could put batei dinim out of business. Be careful what you wish for.

    does the consitituion mean nothing anymore? international law, islamic law, halacha have no place at all in the american justice system. nobody but american politicians can make american law!!!

    the courts must throw out this lawsuit, simply this is the usa not a Muslim country.
    Imagine a man kills his sister because she talked to and according to sharia law that is ok.

    Let me ask you guys a question: wouldn’t you want a US divorce court to deny a civil divorce for a man who refuses to give his wife a get?

    the question is only whether the laws should be considered, not ruled – there was a case in Richmond, VA in the 1920’s about a frum guy who’s wife went off the derech after he died – he was buried in a frum cemetery and she was buried in a reform cemetery – the kids wanted to move him to the reform cemetery – the Frum Rabbonim fought and brought Shulchan Aruch to defend not moving him while the reform ra-bbis said it doesnt matter what shulchan aruch says – the case is online – very interesting
