The New York State Liquor Authority said in a statement obtained by The Associated Press that it had reached an agreement with beer distributors on Saturday night.

The distributors have until Dec. 10 to clear their inventory.

U.S. Sen. Charles Schumer called it “a giant step forward,” but urged the SLA to ban the drinks outright. The senator has called for a federal investigation into the drink companies’ marketing tactics.

The SLA says it is concerned about the caffeinated drinks because they can have as much alcohol as four beers and could be potentially harmful. They have been banned in Michigan, Washington, Utah and Oklahoma.

The federal Food and Drug Administration is reviewing their safety.
